  2. Family Lawyer In Fall River Family Law is a general term to describe a number of different issues involving marriage and children. The majority of issues that we handle in Family Court concern subjects of divorce, child custody, child visitation, child support and spousal support or alimony.

  3. Divorce Lawyer In Fall River Divorce is a legally enforceable dissolution of a marriage resulting from a court judgment. Legal separation is when two spouses live apart separately. Rhode Island does allow legal separation, but it only deals with matters pertaining to children, child support, child custody and separate spousal support. Massachusetts does not recognize legal separation, although they will listen to matters that pertain to children, child support, child custody and separate spousal.

Child Custody Child Support is a required reoccurring payment that one parent who does not have primary custody of the child or children, pays to the other parent who has primary custody of the child. Child support must be used in the benefit of the child and pays for usual expenses such as food, clothing, housing, healthcare and education expenses.

  5. Contempt & Modification Lawyer Contempt is when one party in Family Court does not follow a court order and a motion for contempt is files in Family Court to handle the issue. Common issues that arise are nonpayment of support, not following rules for visitation and not adhering to judgments or temporary orders of the court. Many times when you must file a motion for contempt in Family Court, we usually include a motion for attorney’s fees, as you should not be paying to go to court because your spouse is not following a court judgment or temporary orders. Modifications are used in Family Court to modify a previous order or judgment. It is important to realize that many issues after a divorce judgment has been recognized by the court, are not able to be modified, such as the division of assets or other issues pertaining to money. Although, issues pertaining to child custody and child support are always open for modification, but this will always depend on a particular set of facts and circumstances which must arise before a modification of the previous order or judgment is made.
