Orange County Procurement OrdinanceReciprocal Bid Preference In the event the lowest responsive and responsible bid submitted in response to any Invitation for Bids is by a bidder whose principal place of business is in a County other than Orange County, and such County grants a bid preference for purchases to a bidder whose principal place of business is in such County, then Orange County may award a preference to the (next) lowest responsive and responsible bidder having a principal place of business within Orange County Florida. Such preference shall be equal to the preference granted by the County in which the lowest responsive and responsible bidder has its principal place of business.
Collier County Purchasing OrdinanceBid Preference When a qualified and responsive non-local business submits the lowest price bid, and the bid submitted by one or more qualified and responsive local businesses is within ten percent of the price submitted by the non-local business, then the lowest local bidder shall have the opportunity to submit an offer to match the price offered by the overall lowest qualified and responsive bidder.
Collier County Purchasing Ordinance • The local bidder must submit the offer within five (5) days of notification by the Purchasing Department • If the offer matches the lowest non-local bidder, then award shall be made to the local bidder. • If the local bidder declines or is unable to match the lowest non-local bid, award shall be made to the lowest overall qualified and responsive bidder.
Board Options • Option 1 - Award to Lowest Bidder • Option 2 - Allow the lowest bidder within Orange County to match the lowest bid from the non-Orange County Bidder • Such match must occur within five (5) days of notification by the Purchasing and Contracts Department • Should the bidder within Orange County be unable or unwilling to match the lowest bid, request the Board to award to the lowest bidder
Staff Recommendation • Option 2 - Allow the lowest bidder within Orange County to match the lowest bid from the non-Orange County Bidder • Such match must occur within five (5) days of notification by the Purchasing and Contracts Department • Should the bidder within Orange County be unable or unwilling to match the lowest bid, request the Board to award to the lowest bidder
