Antitrust Admonition ANTITRUST ADMONITION ERCOT strictly prohibits Market Participants and their employees who are participating in ERCOT activities from using their participation in ERCOT activities as a forum for engaging in practices or communications that violate the antitrust laws. The ERCOT Board has approved guidelines for members of ERCOT Committees, Subcommittees and Working Groups to be reviewed and followed by each Market Participant attending ERCOT meetings. If you have not received a copy of these Guidelines, copies are available at the Client Relations desk. Please remember your ongoing obligation to comply with all applicable laws, including the antitrust laws. General Updates and Reminders • Changes to System-Wide Offer Cap (SWCAP) • In accordance with Protocol Section 4.4.11(1)(c), System-Wide Offer Caps, the SWCAP will be $3,000 for Energy and Ancillary Services beginning on Operating Day February 1, 2011 • Note that offer submittals at the new SWCAP take effect only for submissions starting at 00:01 Central Prevailing Time (CPT) on Operating Day February 1, 2011 http://www.ercot.com 3

General Updates and Reminders • Required change in parameters established by Day Ahead Market (DAM) Collateral Parameters Process • In accordance with the DAM Collateral Parameters Process, the default parameters for all DAM activity will change after the DAM has executed for 60 days. • The values, which are listed below, will change effective with the DAM run on January 28, 2011, for Operating Day January 29, 2011 • Counter-Parties may request the form for more favorable parameters by sending a request to ERCOTcredit@ercot.com http://www.ercot.com 4
