New ADA Laws • On July 26, 2010, the US Department of Justice released updated ADA Standards for Accessible Design. • Among the updates are new requirements specifically for public swimming pools. • The level of accessibility depends on the size and type of the pool. • The law became in effect on September 15, 2010. • The compliance took effect on March 15, 2011 • Existing pools shall become compliant with accessibility by March 15, 2012

  3. Determining What the Means of Access242.2 Swimming Pools. At least two (2) accessible means of entry shall be provided for swimming pools Pool lifts comply with 1009.2 Sloped entries comply with 1009.3 Transfer walls comply with 1009.4 Transfer systems comply with1009.5 & 6 & Pool stairs comply with 1009.6

  4. 242.3 Wading Pools. • At Least (1) one accessible means of entry shall provide for wading pools. • Accessible means of entry shall comply with sloped entries • At least one accessible means of entry provided shall comply with1009.2 or 1009.3 • 242.4 Spas. • At least one (1) accessible means of entry shall be provided for spas. • Accessible means of entry shall comply with swimming pool lifts complying with 1009.2; • Transfer walls complying with 1009.4; • Or transfer systems complying with 1009.5

  5. Pools under ADA Regulations fall under either: • Title II(Public Industry) municipal pools, school pools, government owned pools, etc. • Title III (Private Industry) place of recreation, place of lodging, which addresses public accommodations

  6. Pool having less than 300 linear feet of swimming pool wall, no more than one accessible means of entry shall be required. • Pools having more than 300 linear feet must have 2 means of entry. • Wave action pools, leisure rivers, sand bottom pools, and other pools where access is limited to one area shall not be required to provide more than one accessible means of entry. • Catch pools shall not be required to provide an accessible means of entry. • Where spas are provided in a cluster, no more than 5%, but no fewer than one, spas in each cluster shall be required to comply with 242.4

  7. Can multiple pools/ spas at a facility share a lift • The standards require that each operational pool be accessible. Sharing a lift does not satisfy the standards and may create safety issues with stranded swimmers if the lift is moved while they are in the pool.

  8. What Makes A Lift ADA Compliant? Here are some basics to check on your lift. 1. Lift must have a capacity of 300 lbs or more. 2. Lift must have a solid seat and a footrest. Sling seat styles are not compliant and should be replaced. 3. Lift must be self operable from the deck and the water. A lift with manual rotate or hand crank is not compliant and should be replaced.There are also specific requirements for clear deck space and water depths.

Advisory 1009.2.9 Lifting Capacity. • Single person pool lifts must be capable of supporting a minimum weight of 300 pounds • Sustaining a static load of at least 1.5 times the rated load. • Pool lifts should be provided that meet the needs of the population they serve. • Providing a pool lift with a weight capacity greater than 300 pounds may be advisable.
