  2. Context for EGI Tajikistan • Energy deficit in winter months • Non-commercial orientation of energy system; • Forthcoming privatization, restructuring, reforms; • Low level of public involvement and participation; • Regional perspectives EGI-Tajikistan 2010 2

EGI starting in Tajikistan • WRI, OSI and CSOs efforts: Dushanbe-Bishkek, April-2008; • EGI outreach in Tajikistan, September 2008; • Tajik EGI Team: AET, CUT, Nakhustin + deputy of Parliament (cooperation and involvement); • August 2009: Presentation of EGI Primarily Findings in Tajikistan EGI-Tajikistan 2010 3

Applying the EGI Indicator Toolkit to Tajikistan POLICY PROCCESS • Existence of basic legal rules for energy sector; • Law in draft directly may be initiated only by legislative or/and executive authorities; • Relevant energy legislative committee: mid-level capacity and autonomy, high level activity; • Legislative debates:qualitative 4 EGI-Tajikistan 2010

Applying the EGI Indicator Toolkit to Tajikistan POLICY PROCCESS • Legislative committee, as well as whole Parliament work are closed to general public; • Absence of specific norms on disclosure of information for the public, as well as no norms on public participation; • Public associations practically are not involved in policy process; • No ways to obtain information from Parliament; 5 EGI-Tajikistan 2010

Applying the EGI Indicator Toolkit to Tajikistan REGULATORY PROCCESS • Regulatory functions are divided between several agencies and ministries: Government, Ministry of Energy and Industry, Ministry of Economic Development and Trade, Agency Tajikstandard and etc. • Unclear, duplicated and complicated regulatory mechanism without clear responsibilities, tasks and forces; 6 EGI-Tajikistan 2010

Applying the EGI Indicator Toolkit to Tajikistan REGULATORY PROCCESS • Low level of public participation on regulatory process. • Tariff setting: who are regulating tariffs? • IFI’s involvement and “hidden” requests; • No easy way to obtain information on regulatory issues; • “Hidden” attempts to obtaining information from regulators; 7 EGI-Tajikistan 2010

  8. Applying the EGI Indicator Toolkit to Tajikistan SOCIAL ASPECTS • Existence of social programs (compensation policy) in energy sector; • Low level of social responsibilities on both policy and regulatory process; • Social issues are regulated by separate ministry; 8 EGI-Tajikistan 2010

CONCLUSIONS AND RECOMMENDATIONS • Create working group on Electricity Governance Reform (EGR); • Create a broader reference group of consumer and civic organizations to enhance transparency and inclusiveness; • Special focus of both groups is providing transparency, effective regulating system (single regulator) and wide public participation 9 EGI-Tajikistan 2010
