Background • Lagos State collaborated with the World Bank in the year 2003 for a broad Public Sector Reform process to improve Efficiency, Accountability, Transparency and Probity in the conduct of Government Business and to align with International Best Practice. • Consequently, the Lagos State Government enacted the Lagos State Public Procurement Law in October 21, 2011 and the Law became effective in April 2012.

Background Contd • As part of the strategic plans to achieve the State Developmental Goals by Y2025, Lagos State Public Procurement Agency was established in February 2012 with a core mandate to certify all State procurements prior to, during and after the award of any contract • Procurement Officers’ Cadre was created to carry out procurement functions in all the MDAs.

  4. Background Contd • PPA effectively took over the functions of the defunct State Tenders Board and State Consultancy Board in April 1st 2014

Our Products: No. 1 • CERTIFICATE OF COMPLIANCE (COC) • It is an approval document issued to an MDA who has followed the appropriate procurement procedures/ method to select a contractor/ supplier/service provider. It is applicable mostly to capital projects. • e.g. Construction / Maintenance / Renovation of Public Utilities, Supply and Installation of Equipment etc.

Our Products: No. 2 • PPA NO-OBJECTION • A type of clearance issued which enables an MDA to proceed to other stages in the procurement process. • It can also be issued as a clearance for an existing project which is executed in phases. e.g. continuation of Mile 2-Badagry Express road. • PPA NO-Objection can also be issued to MDAs that have the competence and capability to carry out Direct Labour due availability of relevant equipment and personnel.

  10. Our Products: No. 3 • LETTER OF CONFIRMATION • Mostly issued for projects/Programmes utilizing the “Recurrent Budget”. e.g. Public Service Week Celebration, World Health Day, Lagos Black Heritage etc.

Getting the Products • Obtain HE’s Approval • Obtain the necessary sign-offs from relevant MDAs • Availability of funds to execute the proposed project/ Programme (Appropriation/Budget) (VOC or AIE) • Involve the MDA Procurement Department/ Unit for Professional Advice • Ensure that the preferred contractor/ supplier/ service provider is registered with Lagos State Government (Registration / Renewal of Contractors is being reviewed to make it easier and less cumbersome) • Use of Procurement Standard Templates for making requests. Note: Inability to meet any of these conditions delay the issuance of the PPA Approval Instruments. A guideline/checklist has been prepared and this is expected to be completed and submitted along with the requests. This will come out as circular soon.

  12. What we want to achieve……. • To ensure a Transparent, Competitive, Inclusive, Sustainable and Value-for Money Public Procurement System that supports the State’s Developmental Goals and engenders Public Confidence .

How? • Adherence to existing Procurement Circulars issued by the Office of the Head of Service • Follow the Procurement Rules and Guidelines as published by Public Procurement Agency – www.lagosppa.gov.ng • Involve Procurement Officers in your team from the outset • Build Capacity of the Procurement Officers through relevant trainings required to be more proficient on the job
