Legislative Update • HB276 – Reauthorized SW/HW Fees (Signing statement paraphrased – the Constitution of Georgia specifically limits any attempt to dedicate revenues in a general bill unless specifically permitted by the Constitution of Georgia, I would deem this language in the House Bill 276 as being nonbinding)
FY12 HSRA Funding • Fees/fines Collected $13,615,384 • Fees Appropriated $2,939,882 • Local Gov Reimbursement $1,622,178
Hazardous Site Inventory • 556 total HSI sites • 297 active sites with responsible parties identified • 199 cleanups in progress • 67 investigations in progress • 33 no action taken (due to lack of resources) • 124 local gov. solid waste landfills • 64 Hazardous Waste Management sites • 63 orphan sites
HSRA Rule Changes • Provide 60 day deferment of notification scoring • Delist type 5 sites upon concurrence of CSR and execution of UEC • Delineation of releases to soil to Type 1 Standards • Delineation of releases to GW to MCLs • Public notification publish in legal organ • Installation of permanent marker on only one side of UEC restricted area
Brownfields Application Review Fees • $3,000 per application • $1,383,000 to date – most went to general fund • VRP Escrow Account Act passed in 2010 • Allows retention and use of application fees by Brownfields Program

VRP Application Review Fees • $5,000 fee per application • Invoicing $75/hour for EPD overview • Approximately $450,000 collected to date • 47% of staff VRP time is not site-specific
VRP Applications 69 Applications received 55 Applications approved 6 Applications under review 8 Applications withdrawn or awaiting revisions 4 Properties delisted 18 Sites have recorded UECs (4 VRP sites)
