Voire Dire • This is the process before a trial that an attorney will ask questions of potential jurors to determine potential bias. • Attorneys should listen more than talk! • End with 12 jurors
Challenge for Cause • “Will the potential juror be able to remain fair or impartial?” • There is no limit on the number of challenges for cause, but a judge must approve • Made at the beginning of questioning
Questions for Jurors • Include: • Area of Residence • Occupation • Education • Marital Status • Occupation of Spouse • Ages of Children • Does the Juror know the judge, attorneys, plaintiff, defendant, fellow jurors, anything about the case? • Has the Juror been on a jury before? • Does the juror have anything that will restrict them from serving (medical conditions, employment, religious beliefs, ability to follow the law)?
Peremptory Challenge • In a civil case, each side is allowed 8 peremptory challenges. • In a capital murder case, 14 peremptory challenges. • In other criminal cases, 6 peremptory criminal cases. • Must give a reason for the challenges • Made at the end of questioning, based on overall interview
