Federal Law CODE OF FEDERAL REGULATIONS TITLE 33 -- CHAPTER II -- CORPS OF ENGINEERS, DEPT OF THE ARMY, PART 208_FLOOD CONTROLREGS (CFR 33 § 208.10) • The State, political subdivision thereof, or other responsible local agency, whichfurnished assurance that it will maintain and operate flood control works in accordance with regulations prescribed … shall be responsible for the development and maintenance of, and directly in charge of, an organization responsible for the efficient operation and maintenance of all of the structures and facilities during flood periods and for continuous inspection and maintenance of the project works • … inspections shall be made immediately prior to the beginning of the flood season; immediately following each major high water period, and otherwise at intervals not exceeding 90 days • It shall be the duty of the superintendent to submit a semiannual report to the District Engineer covering inspection, maintenance, and operation of the protective works
State Law - Authority • Act 523 of the Regular Session of 2009 §214.6.3. Functions and responsibilities; hurricane protection and flood control A. Legislative Intent (4) This Section provides for the functions, powers, and responsibilities of the Office of Coastal Protection and Restoration, which office is charged with oversight of the design, construction, extension, improvement, repair, and regulation of hurricane protection and flood control projects in the coastal zone area.
….Authority • Louisiana Revised Statutes 49:214.6.3.B states: (2) The inspection of hurricane protection and flood control levees and structures within the coastal area shall be the responsibility of the Office of Coastal Protection and Restoration. The executive director or his designee shall regularly cause such structures to be inspected and shall maintain a report of such inspections.
State Law • Louisiana Revised Statutes 38:301 states: B: “…the care and inspection of levees shall devolve on resident commissioners, assisted by such inspectors and watchmen as may be appointed pursuant to regulations which the boards are hereby authorized to adopt. Each resident commissioner and any inspector or watchman who may be appointed shall attend once during his term in office an educational training program conducted by the office of public works or its successor.”
A Reason for Inspections • Eligibility to receive federal assistance to help repair flood control works damaged in floods. (Public Law 84-99, Rehabilitation and Inspection Program)
