13. Teen Pregnancy Prevention Program The purpose of the TPP program is to provide education and support to communities, funding locally designed programs aimed at preventing adolescent and unintended pregnancy and preventing sexually transmitted infection including HIV.

Program Goals and Legislative History Information and Education (I&E) CA Welfare and Institutions Code Enacted: 1973, Section 14500-14512 OFP Statute: 2003, Section 14504.3 The goal of the I&E Program is: To decrease teenage pregnancies through educational programs that equip teens at high-risk for pregnancy with the knowledge, understanding, and behavioral skills necessary to make responsible decisions regarding at-risk behavior. Community Challenge Grant (CCG) CA Welfare and Institutions Code Enacted: 1996, Section 18993-18993.9 OFP Statute: 2003, Section 14504.1 The goals of the CCG Program are: To reduce the number of teenage pregnancies and teenage single parents. To promote responsible parenting. To promote the involvement of the biological father in economic, social, and emotional support of his children. Program Goals and Legislative History • TeenSMART Outreach Program (TSO) • CA Welfare and Institutions Code • Enacted: 1996, Family PACT, Section 24000-24027 • OFP Statute: 2003, Section 14504.2 • The goals of the TSO Program are: • To reduce teenage pregnancies. • To reduce the incidence of sexually transmitted infections among sexually active teens through enhanced reproductive health care counseling, pregnancy prevention education and sexually transmitted infection risk reduction efforts for adolescents accessing Family PACT TeenSMART clinics. • Funded Projects: • 21 Local Projects – Family PACT Clinics 18

Funding Cycle and Funding Source Community Challenge Grant (CCG) Grant Term: 2005-2010 - $19.4M Annually Federal – TANF Dollars Information and Education (I&E) Grant Term: 2003-2011 - $3.175M Annually Fifty percent of the original grant amount for each grantee is State General Fund (SGF).  The SGF is also used to provide dollar for dollar match of Title XIX funding in accordance with Federal Regulations. The percentage of Title XIX for each grantee is based on time study activities. Male Involvement Program (MIP) Grant Term: 2004-2011 - $2.3M Annually Fifty percent of the original grant amount for each grantee is SGF.  The SGF is also used to provide dollar for dollar match of Title XIX funding in accordance with Federal Regulations. The percentage of Title XIX for each grantee is based on time study activities. TeenSMART Outreach Program (TSO) Grant Term: 2003-2011 - $1.825M Annually 50% State General Funds/ 50% Federal Title XIX

21. Federal Financial Participation (FFP) MIP and I&E projects are required to comply with federal funding requirements to receive Federal Financial Participation (FFP) matching funds. Reference: An FFP User Guide is available to MIP and I&E projects. The Guide provides information on the Federal Title XIX funding and explains the requirements that projects must comply with in order to receive the maximum allowable federal funding.

Federal Financial Participation (FFP) • FFP provides Federal Title XIX/Medi-Cal reimbursement for approved State programs with specific activities that meet the following objectives: • Bringing potential eligibles into the Medi-Cal system to determine their Medi-Cal eligibility. • Bringing Medi-Cal eligible people into Medi-Cal services.

FFP Requirements • To obtain FFP reimbursement, programs must: • Meet the two FFP objectives • Maintain secondary documentation for the time-studied activities • Complete time studies for all Title XIX funded staff, including staff who are only partially funded by Title XIX Projects are required to use the most recent version of the Office of Family Planning-approved timestudy documents located at ww2.cdph.ca.gov/programs/tpp/pages/default.aspx www.etr.org/ofp

Target Populations • Adolescent boys • Young men • Youth in a variety of setting including schools, juvenile justice facilities, community-based settings, social services and youth agencies, and foster care programs. • Parents of high risk youths and other adults responsible for serving youths-at-risk.* * Programs may serve these target populations, but activities may not qualify for Federal Financial Participation match.

OFP Requirements • Compliance with CA Education Code - Chapters 51930-51939 • Compliance with CA Health Accountability Act (AB629) for grant amendments executed on or after January 1, 2008. • Information about Family PACT services and referrals to reproductive health services. • Information on the California Safely Surrendered Baby Law and local resources. • Prevention education must have sufficient length of time: 6 hours minimum.

California Education Code CURRICULUM/MATERIAL SHALL: • Be age appropriate. • Provide information that is medically accurate, up-to-date and objective. • Encourage communication with Parents or Guardians. • Teach respect for marriage and committed relationships. • Provide pupils with skills for making and implementing responsible decisions about sexuality. 36

California Education Code • CURRICULUM/MATERIAL SHALL: • Be available on equal basis to an English learner, or alternative options consistent with the curriculum. • Be appropriate for use with pupils of different races, genders, sexual orientation, ethnic and cultural backgrounds and pupils with disabilities. • Accessible to pupils with disabilities, with modification and instruction in alternative formats and auxiliary aids. • Not teach or promote religious doctrine. • Not reflect or promote bias against any person on the basis of disability, gender, nationality, race or ethnicity, religion, or sexual orientation.

California Education Code • COMMENCING IN 7TH GRADE, CURRICULUM/MATERIAL SHALL PROVIDE INFORMATION ABOUT: • Contraception • Provide information on effectiveness and safety of all FDA-approved contraceptive methods, including information on emergency contraception • Sexually Transmitted Disease • Transmission - How STDs are transmitted and how they are not transmitted • Protection - All FDA-approved methods of reducing the risk of contracting sexually transmitted diseases • Resources - Information on local resources for testing and medical care for STDs

39. California Education Code • COMMENCING IN 7TH GRADE, CURRICULUM/MATERIAL SHALL PROVIDE INFORMATION ABOUT: • Abstinence • Teach that abstinence from sexual activity is the only certain way to prevent pregnancy and sexually transmitted disease and HIV. • Provide information about the value of abstinence, while also providing medically accurate information on other methods of preventing pregnancy and STDs.

40. California Education Code EC Section 51933 requires that classes that provide instruction on human development and sexuality in grades seven through twelve shall include medically accurate, up-to-date information about all FDA-approved methods for: 1) reducing the risk of contracting STDs, and 2) preventing pregnancy. EC Section 51933, prohibits: • Teaching “abstinence-only” education, in which information about preventing pregnancy and STDs is limited to instruction on abstinence from sexual activity. • Instruction that emphasizes the benefits of abstinence while focusing exclusively on the failure rates or perceived disadvantages of condoms and other contraceptives.

41. California Education Code • COMMENCING IN 7TH GRADE, CURRICULUM/MATERIAL SHALL PROVIDE INFORMATION ABOUT: • California Law on Surrendering Babies • Instruction and materials shall provide pupils with information on surrendering physical custody of a minor child 72 hours or younger. Include local safe havens/drop-off locations.

42. California Education Code • OTHER REQUIREMENTS: • Instructor Training - Instructors must be trained on medically accurate research on human sexuality, pregnancy and STDs. • Parental Notification – At the beginning of the school year or at the time of the pupil’s enrollment, offering an opportunity to preview materials. • Parental Consent – Passive consent is required. A parent may excuse a student from attending all or part of the program through a signed notice to the school.

44. Compliance Requirement for MIP/I&E MIP and I&E grants are being amended due to FFP requirement and the extension of the grant term to June 30, 2011. MIP and I&E projects will be required to sign a Certification of Compliance with the Sexual Health Accountability Act of 2007.

45. Sexual Health Education Accountability Act CURRICULUM/MATERIAL SHALL: • Include information that is medically accurate, current and objective. • Be culturally and linguistically appropriate for its targeted populations. • Be age appropriate for its target population. • Not teach or promote religious doctrine. • Not reflect or promote bias against any person on the basis of disability, gender, nationality, race or ethnicity, religion, or sexual orientation. • Provide information about the effectiveness and safety of at least one or more drug or device approved by the federal Food and Drug Administration for preventing pregnancy and for reducing the risk of contracting STDs.

46. Sexual Health Education Accountability Act • PROGRAMS DIRECTED AT MINORS UNDER 12 YEARS OLD • CURRICULUM/MATERIALS SHALL: • The program shall include information that the only certain way to prevent pregnancy and STD is by abstinence from sexual intercourse/activities that have been proven to transmit STDs. • Programs directed at minors under 12 years may, but are not required to, include information about the effectiveness and safety of at least one or more drug or device approved by the federal Food and Drug Administration for preventing pregnancy and for reducing the risk of contracting STDs.

47. Sexual Health Education Accountability Act • OTHER REQUIREMENTS: • Agencies shall attest in writingthat its program complies with Health and Safety Code, Sexual Health Education Accountability Act requirements.* • Agencies providing programs in publicly funded schools must comply with the Education Code requirements for Comprehensive Sexual Education. • Agencies providing programs in publicly funded schools shall indicate in writing how their program fits with the school’s plan to comply with the Education Code requirements for Comprehensive Sexual Education. • The Health and Safety Code, Sexual Health Education Accountability Act does not supersede Education Code requirements for publicly funded schools (including charter schools). * Requirement applies to prevention education programs regardless of the setting/site.

48. Sexual Health Education Accountability Act OTHER REQUIREMENTS: • Individuals providing instruction or information shall know and use the most current scientific data on human sexuality, human development and sexually transmitted diseases. • Non-compliance may result in termination or other appropriate action.
