Monitoring and Enforcement 2009 National DBE Conference FAA Office of Civil Rights“We are who we serve”
Monitoring and Enforcement Requirements • Airport to establish monitoring and enforcement procedures, and mechanisms. • Keep running tally of attainments versus commitments. • Ensure work committed to DBE is actually performed by the DBE. • Ensure prompt payment and return of retainage. • Voluntary Compliance
Examples of Program Issues in Monitoring and Enforcement • Running tally of attainment versus commitment inconsistently maintained, or done at end of contract. • Inconsistent or no on-site monitoring of DBE’s work. • Complaints of slow payment by DBEs. • Retainage released by airport at project completion.
Examples of Best Practices in Monitoring and Enforcement • A form which identifies each subcontractor coming on-site for airport security purposes is also used to confirm the DBE firm coming on-site. Form shared with Engineering and DBELO office. • Engineering Dept. does on-site review of work performed by the DBE, and coordinates findings with DBELO office. • DBELO office conducts on-site reviews. • Engineering maintains database of DBE committed work, and attainments; keeps runny tally at 30%,60%, and 90% project completion. Database shared with DBELO office.
Best Practices Summary • It takes a village… • Leveraging Resources • existing mechanisms can be used for DBE monitoring purposes. • engineering or business office can assist in DBE on-site monitoring. • Coordination • Follow-through
