  2. Definitions AuthorizedEmergencyVehicles–VehiclesoftheFireDepartment,Security, and Medicalwhenrespondingwithemergencyequipmentactivated. CompetentPerson– Individual(s)capableofidentifyingexistingandpredictable hazards in thesurroundingsor workingconditionswhichareunsanitary, hazardousor dangeroustoemployees,and whohas authorizationto takeprompt corrective measurestoeliminatethem. Contractor–Any agent/agencyengagedbyAmber Chemical Inc.Microwave throughwrittenor electronic contract (or otheragreement)to perform workon ACIpropertiesandthosepropertiesforwhichACI has operatingresponsibilities. Notincludedarecontractoremployeeswhoworkunderthedirectsupervisionof ACI personnel. These employees would fall under AmberChemical Inc.Environmental,Safety andHealth(ESH) programs. ESH–Environmental,SafetyandHealthrepresentative. HotWork –Any operationthatinvolvesopenflames or producesheat or sparks. Someexamplesincludewelding,cutting, brazing,grinding,soldering,torch appliedroofing,etc.

  3. Definitions MSDS(MaterialSafetyDataSheet)–Detailsthehazardousproperties oftheproductsalongwith theprecautionarymeasuresrequiredforsafe use. Other-ThanSerious Violation–Aconditionthatdoesnothavethe samepotentialforcausingbodilyharm,yetmaycontributetoa decrementin bodilyfunctionsorincreasebodilystress. POC(PointofContact)–AnAmberChemicalInc.representative responsibleforproviding oversightofContractorstoensurecompliance withthetermsand conditionsofthecontract,purchaseorder,orother authorizingdocuments. SeriousViolation–Aconditionthatcouldresultin aninjuryorillness, whichcausesprolongedortemporaryimpairmentofthebodyor substantiallyreducesefficiencyonoroffthejob. Vehicle–Anymeansoftransportationusedtotransportpersonnel and/orproperty/equipment(e.g.,automobiles,trucks,lifttrucks,scooters, golfcarts,andbicycles).

Purpose • The purpose of this presentation is to inform contracting companies of • Amber Chemical Inc.EHSrequirements. • Theprojectmanagerand/orsupervisorfromthecontractingcompanyisrequired toreviewthispresentationpriortocommencementofworkatAmberChemical Inc.The contracting company is responsible for ESH compliance by its own employeesandsubcontractorsandfordisseminationofESHrequirementstoits employees andsubcontractors before anycontractual work begins. • This presentation is an overview of basic applicable company and regulatory standards and should not be considered as a substitute for provisions of the Occupational Safety and Health Act of 1970 or other local, state and federal occupational environmental, safety, and health programs. Any discrepancy betweenthispresentationandregulatoryandcontractualrequirementsshallbe resolvedbyusingthemoststringentrequirement.

Contractor/SupplierSafety&Health ItisthepolicyofAmber Chemical Inc.toprovideasafeandhealthyworking environment.ThisappliestoContractorpersonnelaswellasAmber Chemical Inc. employees. “ESHis Everyone’sResponsibility” Contractor SafetyandHealthProgram •AllContractors,shallbefamiliarwithandcomply,at alltimes,withall applicableregulationswhileperformingworkonAmberChemicalInc. premises. •TheContractorshallcarefullyread andevaluatethesafety provisionsofeach contractto determinethesafety requirementsof thecontract. Thisincludesbut isnot limited to theassignmentof personnel,trainingrequirementsand requiredsafetyequipment. •TheContractoris responsiblefor insuringflowdownofsafety,healthand environmentalinformation,providedbyAmber Chemical Inc.,to alltheir employees and Subcontractors. “ESHISEVERYONE’S RESPONSIBILITY”

ContractorResponsibilities • •Contractor • Thecontractor willnotunderany circumstancesusethecompany’s equipmentor property unlessstatedinthecontractand approvedbythe Facilities Manager • Iflargerentalequipment(cranes,lifts, etc.)is usedbythecontractor, contactinformation(includingthename ofthecompanyit is rentedfrom anda phone number)shallbeavailableuponrequestofthecompany. • - ALL CONTRACTORS MUST CALL THE FACILITIES MANAGER PRIORTOPERFORMINGWORKATANYAMBER CHEMICAL INC. SITE- • •Contractors employedinconnectionwiththeconstruction, painting,repairing, • maintenance,renovation,demolitionof any fixedstructureor itspartsshallcomply withOSHAStandard29CFR Part1926fortheConstructionIndustry. • •Contractors may alsohavecompliancerequirementstoOSHAStandard29CFR • Part 1910forGeneralIndustry andto other Federal,State,andlocalregulations. • •Contractors should obtain copies of the OSHA Standards for the Construction Industry(29CFRPart1926)andOSHAorGeneralIndustry(29CFRPart1910) prior tostartingworkatAmber Chemical Inc..

  8. "Competent person"meansonewhois capableof identifyingexistingand predictablehazardsinthesurroundingsor workingconditionswhichare unsanitary,hazardousor dangeroustoemployees,andwhohas authorizationtotakeprompt corrective measurestoeliminatethem. ◦ OSHA1926.32(f) • "Qualified"means onewho,bypossessionof a recognizeddegree,certificate, orprofessionalstanding,or whobyextensiveknowledge,trainingand experience,has successfullydemonstratedhisabilitytosolveor resolve problems relatingtothesubjectmatter, the workor theproject. • ◦ OSHA1926.32(m) • Amber Chemical Inc.and OSHAconstructionstandardsrequireaCompetentPersonforactivities suchas: • Scaffolding, • FallProtection, • Cranes, • Excavations/Trenching/Shoring, • Steel Erection, • Ladders.

  9. AmberChemicalInc.maintainsa databaseofhazardouschemicals usedat ourfacilities. Materialsafetydatasheets(MSDS)forthose hazardouschemicalsareavailable fromyourPOC. ContractorswithemployeesworkingonAmber Chemical Inc.premises shall reviewtheir contract(s)forinformationconcerninghazardous chemicalsandprovide trainingandpersonalprotectiveequipmentas requiredtoemployeesto safelyperformtheirwork. TheContractorshall providetothePOC,inadvanceofanywork, associatedMSDS’s foreachhazardousmaterialintendedtobeused. Hazardous materials on company premises shall be labeled in compliance with OSHA 29 CFR Part 1910.1200, “Hazard Communication.” Labels must be legible and replaced when torn or defaced. PersonalProtectionEquipmentisrequiredatalltimeswhenhandling chemicals

TrafficSafety • Contractorsshallnotcloseorimpedetheuseofanyaisle, road,orexit(eventemporarily)withoutapprovalfromthe POC. • Vehiclesshallyieldto pedestrians.Pedestrianshavetheright- of-wayatalltimes. • Duringlunchandbreakperiodsandatshiftchanges,vehicle operatorsshalluseextremecautionto avoidvehicle- pedestrianaccidents. • Allvehiclesshallstopandgivetheright-of-waytoemergency • vehicles. • Amber Chemical Inc.hastheperogativeof suspending drivingprivilegesof contractors,vendors,andsupplierswho havedemonstrated unsafedrivingpractices.

  11. Traffic Safety continued: • No Cell phone use when operating Equipment of any type. (trucks, cars, forklifts etc.) • No vehicles are allowed to idle unnecessarily. • All vehicles being loaded will have wheels chocked, by driver.

  12. Noalcoholic beverages,drugs,explosives, firearms,ammunition, gambling materialor personsundertheinfluenceof alcohol/drugswill beNOT permittedAmber Chemical Inc.property.

  13. Smoking is permitted in desiginated areas only.

  14. Personalprotectiveequipmentshallmeettherequirementsof29CFR 1910and1926. • HeadprotectionshallbeselectedandusedinaccordancewithCFR1926.100. ANSIZ89.1approvedhardhatsshallbewornonall constructionsites. • Suitableeye/faceprotectionshallbeselectedandusedinaccordancewiththe requirementsof29CFR1926.102andshallbewornwhenexposedtooperations generatingahazardtotheface. • Footprotectionshallbeselectedandusedinaccordancewith29CFR1910.136 and29CFR1926.96. • Constructionsitesshouldbeconsidereda“hardhat–safetyglasses–workshoe”areasunlessthepotentialforahazardisnon-existentandpriorapprovalhasbeen obtained fromthePOCandESH. • Workareasidentified,"EYEPROTECTIONREQUIRED",are100%eyeprotection • areas.Theseareasrequiretheuseofeyeprotectionatall times. • Amber Chemical Inc. will not supply contractors with PPE

  15. Thecontractorwill supplyall necessaryDepartmentofTransportation approveddrums. Thecontractorshall ensurethedrumsarestoredand labeledproperly. Disposalofhazardouswaste,includingcontaminatedsoilsorrefuse,shallbe donebyanapprovedACIdisposalcontractorinaccordancewithregulatory requirements. Contractorwillberesponsibleforalldisposalcost. Disposal of waste generated from operations (i.e., paint, solvents, floor coatings,etc.) mustbecoordinated withthePOC andESHprior togeneration. Facility generated waste (i.e., process tank cleaning solutions, lead abatement,etc.)willbethesoleresponsibilityofthecompanyincoordination withthePOC. Undernocircumstancesmayanymaterialofanykindbedischargedtoany sewerorstormdrainwithoutapprovalfromESHrepresentativeorPOC.

  16. Inbuildingswherecranes areinoperation,thecrane operatorwillblowa whistleor sounda buzzer towarn personnelofapproachingcrane(s) andload(s). Atno timewillpersonnelstand or walkunder acrane load. Theuseofhoistingequipmentsuchaspoweredcranes or hand-powered hoisting devices is prohibited unless approval has been obtained by the POC and ESH representative. 

  17. All places ofemploymentshall be kept clean and orderly. Materials and equipment shall bestoredindesignatedplaces. Sharpprojections,whereinjury mayoccur,shall beeliminated. Electrical cord sets and air hosesusedinworkareasshall notcreateatrippinghazard. Objectsshallnotbe“stored”on the top of any cabinets, electricalpanels,etc. Chemical containers shall be stored properly at the end of theworkshift. Outside dumpsters shall be kept effectively covered and closedunlessin use. Aisles and exits must be kept clearatalltimesandmaterials and equipment stored in designatedplaces.

  18. Thecontractor shoulddeterminethelocationof therecyclingand/ordisposal facilities to be usedforallmaterialsrecycledand/ordisposedof whichwillbe generatedfromtheworkperformedunderthecontractas wellas their methodof transport,priortothecommencementofwork. Thecontractorshouldtransportnon- recyclablesolidwastesto a statepermitteddisposalfacility thataccepts these materials for disposalor reclamation.Pleaseuseappropriaterecyclingcontainers (i.e.cardboard) The contractor shall be responsible for collecting and removing solid wastes, including all construction debris (including concrete), and segregating recyclable wastesfrom non-recyclablewastes. Recyclablematerialsincludingconstructiondebristhatcannotbereusedonsiteby thecontractorshouldbetransportedbythecontractortoavalidrecyclingfacilitythat reclaimsandrecyclesthesematerials. Recyclingcontractorsshouldmaintainrecords(i.e.,scaleorrecyclingreceiptsthat reflect quantity disposed) for all solid waste material re-used, recycled or, if necessary,landfilledthroughoutthecontractperiod,andprovidetoPOC or ACI Safety Manager.

  19. Accidentpreventionwillbetheresponsibilityofthecontractortoinitiate andmaintain programsto: • Provide fordaily safetyinspectionsofthejobsite(s),materials,tools,andequipment. • Permitonlythoseemployeesqualifiedbytraining,licensedorexperienced,as appropriate,tooperatemachinery,tools,orequipment. • Conductweekly10-15minutesafetytalkstoreinforcesafetyawareness.Topics shouldberelatedtoworkunderthecontract. • Ensurewarningsarepostedtoinformemployeeofhazardsorpotentialhazards.Itistheresponsibilityofthecontractortosoadviseit’semployees,subcontractors,and suppliers. • Ensurethataffectedemployee(s)receive(s)necessary firstaid ormedicaltreatment. • Promptly report all accidents/injuries/illnesses to the POC. Immediately notify Safety Manager of any serious accidents or injuries. Secure the area and equipment if blood or other bodily fluids are present.

  20. ElectricalSafety Extensioncords,constructedofmetaljunctionboxesandflexiblecords shallnotbeused. Stayclearof“HighVoltage”locations-unlessapprovedbythePOC. Piggybackingofelectricalcordsisprohibited. Improper Installation andUse GroundProngMissing

  21. Fall Protection • Contractors shall provide their own fall protection equipment (i.e., harness, lanyard, vertical / horizontal life lines, etc.). Company owned fall protection equipmentor componentsarenottobeusedbycontractors. Non-CompliantGuardrail No Fall ProtectionEquipment

  22. “Hot Work”-Welding/Cutting Weldingonanautomaticsprinklersystemis prohibited(stillcharged) Only approved containers and portable tanks shall be used for storage and handlingofflammable& combustibleliquids. Anewpermitisrequiredatthebeginningofeachworkshiftorastheresultof changedworklocation(s)or conditions. OncetheHotWorkiscompleteorthepermithasexpired,callPOCforrecheck ofthearea. After clearanceby POC,originalpermit willbepickedup. Allhotworkshallbeproperlyshieldedwhenperformedwithinoroutsideany building. Hotworkwill require a dedicated Fire Watch person (FWP). Thecontractorshallprovidefireextinguishersofthetype&sizerequiredatallworksites.

  23. Lockout/Tagout(LOTO)-Hazardous Energy Control ProvidethePOC withdocumentation LOTOTrainingfor those employees engagedin, supervisingor servingas stand-bysforLOTO activities. Affectedcompanyandcontractor employeesshallbeinformedof LOTOactivitiesintheirworkarea. Contractor shallnotifyPOC(at least 24hoursinadvance)ofneedfor systemoutageofFire Protection Systems. ACILock&TagOut

  24. Painting,SandblastingandPressureWashing Indoorspraypaintingispermittedonlyinauthorizedpaintspraybooths/buildings withpriorapprovalfromthePOC andESH. Outdoor spray or electrostatic painting, sand or other abrasive blasting, and pressurewashingisstrictlyprohibitedunlessapprovalisobtainedfromthePOC and ESHpriortothe commencementofwork. Brush and/or roller painting may be accomplished in other buildings or areas whereauthorizedbythePOC. Contractor must ensure that all applicable OSHA requirements are met regardingpotentialexposureoftheirpersonneltohazardousmaterials. Paintingofbuildingstructures(interiororexterior)willbeaddressedonacase- by-casebasiswithESH andPOC. Contractors involved in on-site painting operations must report paint and associatedsolventusagemonthly.

  25. The following pre-work Environmental, Safetyand Health (ESH) documents (forms) must be signed and submittedtotheCompanyPointofContactprior tothecommencement of work: • Competent Person Designation - Prime construction contractors working at ACI owned or operated facilities are requiredtohaveacompetentpersonon-siteatalltimes.The contractor shall submit to the POC a list of “Competent Persons” as defined and required by specific OSHA standards.
