4. 2- LISTED BUILDING • A listed building in the UK is a building or other structure officially designated as being of special architectural, historical or cultural significance. It is a widely used status, applied to around half a million buildings. • A listed building may not be demolished, extended or altered without special permission from the local planning authority (who typically consult the relevant central government agency, particularly for significant alterations to the more notable listed buildings) Dr Nihad Almughany, Architectural Conservation, 1st Sem. 2009-2010

5. 2- LISTED BUILDING (cont.) • Owners of listed buildings are, in some circumstances, compelled to repair and maintain them and can face criminal prosecution if they fail to do so or if they perform unauthorized alterations. Because of this, and because listing can limit the options available for significant expansion or improvement, the law allows for owners of listed buildings to object to the listing. • Listing normally covers both the exterior and interior, so that major changes to a floor layout (for example) would need approval before any changes could be implemented. 6. 3- ARCHAEOLOGICAL BUILDING • تشمل عبارة ”الأثر القديم ” البناء الأثري وتعني : • ”أ“ أي أثر منقولا كان أو غير منقول وأي جزء من أرض أنشأته أيد بشرية أو كونته أو نقشته أو بنته أو صنعته أو أنتجته أو غيرت معالمه بأي وجه آخر قبل سنة 1700 ميلادية ، وأي جزء من ذلك الأثر أضيف إليه أو أعيد بناؤه أو ضم اليه بعد ذلك التاريخ، أو • ”ب“ البقايا البشرية وبقايا الحيوانات التي يرجع تاريخها الى ما قبل سنة 600 ميلادية ، أو • ”ج“أي بناء يرجع تاريخه الى ما بعد سنة 1700 ميلادية قد يعلن المدير أنه أثر قديم بأمر يصدره ( تسجيل المبنى ). • قانون الاثار القديمة - فلسطين 51 / 1929 Dr Nihad Almughany, Architectural Conservation, 1st Sem. 2009-2010

7. 3- ARCHAEOLOGICAL BUILDING (cont.) • يعتبر أثراً كل عقار أو منقول أنتجته الحضارات المختلفة أو أحدثته الفنون والعلوم والاداب والأديان من عصر ما قبل التاريخ وخلال العصور التاريخية المتعاقبة حتى ما قبل مائة عام متى كانت له قيمة أو أهمية أثرية أو تاريخية باعتباره مظهرا من مظاهر الحضارات المختلفة التي قامت على أرض مصر أو كانت لها صلة تاريخية بها ، وكذلك رفات السلالات البشرية والكائنات المعاصرة لها • يجوز بقرار من رئيس مجلس الوزراء بناء على عرض الوزير المختص بشئون الثقافة أن يعتبر أي عقار أو منقول ذا قيمة تاريخية أو علمية أو دينية أو فنية أو أدبية أثرا متى كانت للدولة مصلحة قومية في حفظه وصيانته وذلك دون التقيد بالحد الزمني الوارد بالمادة السابقة ويتم تسجيله وفقا لأحكام هذا القانون وفي هذه الحالة يعد مالك الأثر مسئولاً عن المحافظة عليه وعدم احداث أي تغيير به وذلك من تاريخ ابلاغه بهذا القرار بكتاب موصى عليه مصحوب بعلم الوصول • قانون حماية الآثار - ج م ع رقم 117/1983 Dr Nihad Almughany, Architectural Conservation, 1st Sem. 2009-2010

8. 4- ARCHAEOLOGICAL AND LISTED BUILDING PARTS • البناء الأثري أو المسجل يشمل : • المبنى ذاته • أي عنصر أو منشأ متصل بالمبنى • أي عنصر أو منشأ في حيز ومحيط المبنى وبالرغم من عدم اتصاله به فإنه يشكل جزء من الأرض وتكوين المبنى • الأثاث وتنطبق على كل هذه العناصر القاعدة التالية : ” أي هدم أو تغيير أو تدخل في تلك العناصر يحتاج الى إذن مسبق من الجهة المختصة“ Listed building consent Dr Nihad Almughany, Architectural Conservation, 1st Sem. 2009-2010

16. 6- HERITAGE CLASSIFICATION • بعض معايير تصنيف التراث حسب توصيات الحلقة الدراسية ” أسس ومعايير تصنيف المباني والمدن التراثية الاسلامية وكيفية الحفاظ عليها“ – 1997 م • معيار القيمة المعمارية : الطراز – الطابع – الشكل – التكوين – الوظيفة – الخصوصية – طريقة الانشاء – التعبير ... الخ . • معيار القيمة العمرانية : المكانية – الانسجام – التجاور – خط السماء – التناقض – القيمة البصرية – النسيج العمراني – الألوان . • معيار القيمة الاجتماعية : نمط الحياة – العادات والتقاليد – الارتباط بين فئات المجتمع – التعليم – الوعي – القيم . 17. 6- HERITAGE CLASSIFICATION (cont.) • تابع بعض معايير تصنيف التراث حسب توصيات الحلقة الدراسية ” أسس ومعايير تصنيف المباني والمدن التراثية الاسلامية وكيفية الحفاظ عليها“ – 1997 م : • معيار القيمة الاقتصادية : دور المبنى في الحركة الاقتصادية – الانتاج الحرفي والصناعات الخفيفة – عوامل الجذب ...الخ. • معيار القيمة الزمنية : زمن انشاء المبنى أو المنطقة – التعبير عن طراز أو عصر – التتابع الزمني. • معيار التفرد : وجود أو عدم وجود احد المميزات الهامة بالمبنى التي تميزه عن المشابه له في زمن وجوده أو في الماضي. 18. 7- GRADES OF LISTING • Three grades of listing exist in Britain : • I , II* , II in England and Wales. • A, B , C in Scotland • First Grade I or A is given to buildings of outstanding interest . • The second grade II* or B is given to buildings that are particularly important . They are not quite so outstanding but still excellent. • The third grade II or C is graded to the vast majority of buildings that are of “ special interest“ .
