Definition of Used Oil • Used oil means any oil that has been refined from crude oil, or any synthetic oil, that has been used and as a result of such use is contaminated by physical or chemical impurities • Title 128, Chapter 1, Section 139
Management of Used Oil • Containers and aboveground tanks used to store used oil • In good condition • No severe rusting, apparent structural defects or deterioration • Not leaking • No visible leaks • For containers and aboveground tanks with a volume of 25 gallons or greater, be labeled or marked clearly with the words “Used Oil”. • Land disposal of waste oil is prohibited, Title 132, Chapter 16, Section 001.05 • Use a reputable oil recycler • To be included in the threshold determination for SPCC applicability
Spills of Used Oil • No person shall release, cause to be released or allow the release of an oil into or upon the waters or land of the state • Title 126, Chapter 18, Section 001 • Notification requirements for any release or suspected release of an oil • Immediate notification required regardless of the quantity of oil released beneath the surface of the land or impacts or threatens waters of the state or threatens public health and welfare • Immediate notification required of a release upon the surface of the land exceeding 25 gallons • Within 24 hours, perform all necessary steps to stop the release and contain all released materials
Energy Recovery • Used oil burned for energy recovery is subjected to the regulations in Title 128, Chapter 7, Section 010
Terne-Plated Used Oil Filters • Terne-plated filters are made from a mixture of lead and tin • The filter would fail the TCLP test for lead. • Lead level – 5.0 mg/L • Terne-plated filters must be disposed as hazardous waste or recycled as scrap metal • Scrap metal exemption 40 CFR 261.6(a)(2)(iv) • Members of the Filter Manufacturers Council agreed to eliminate terne-plate in all filters produced after January 1, 1993
Non-Terne Plated Used Oil Filters • Non-terne plated oil filters are not constructed with lead and tin mixture • According to Title 128, Chapter 2, Section 009, non-terne used oil filters are not hazardous waste if not mixed with wastes listed in Chapter 3, 011 through 016 (F, K, P & U listed wastes), if these filters are gravity hot-drained.
Gravity Hot-drained Methods • Puncturing filter anti-drain back valve or filter dome end and hot-draining • Hot-draining and crushing • Dismantling and hot-draining • Any other equivalent hot-draining method which will remove used oil
Definition Hot-drained • Hot-drained means that the oil filter is drained near engine operating temperature and above room temperature • Title 128, Chapter 2, Section 009.12E
Disposal of Non-terne Plated Used Oil Filters • Recycling is the recommended option • Check with DEQ for the directory of used oil filter recyclers • If a recycler cannot be found, crushed oil filters or properly drained oil filters may be disposed in a permitted solid waste landfill
