B&H’s obligations: 1. Institutional strengthening and capacity building in the domain of environmental protection; 2.Implementation of already adopted legislative instruments; 3. To ensure the efficient functioning of the environmental monitoring system
Institutional strengthening and capacity building in the domain of environmental protection (1) • Establishment of an environmental protection agency at state level • Desision for environmental performances • Advisory services • Developing methodologies • Process is currently ongoing
Institutional strengthening and capacity building in the domain of environmental protection (2) • Enactment of an environmental framework law at state level Points for possible inclusions into the environmental framework law are listed: • Clarification of the competency distribution structure • Establishment of the principles and mechanisms for integrating environmental concerns into other sectors • Complying with the requirements of EU and international conventions to which BiH is a Party. • Establishment of national reference centers regarding: air quality, climate changes, water, biodiversity and waste management • Process is ongoing
Institutional strengthening and capacity building in the domain of environmental protection (3) • Inspection reform (WB project) • Establishing a joint inspectorate at entity and cantonal level • Reorganizing the inspectorates including, Rationally organised, regionally grouped and independent inspection network • Process is ongoing
Institutional strengthening and capacity building in the domain of environmental protection (4) • PRSP -Poverty Reduction Strategy PaperMedium-term development strategy, (adopted on February,2004) • Enactment of a regulation on substances which have negative effect on the ozone layerin BiH(obligations derived from Montreal agreementa) • Strengthening of the National Ozone unit • Strengthening the role of the Steering Committee • Enactment of a Law on movement of hazardous substances Process is ongoing
Institutional strengthening and capacity building in the domain of environmental protection(5) • Study that has been carried out: “Functional review of Environmental Sector in B&H” (CARDS) Proposed measures are: .to create a conceptual capacity at the centre, • to streamline the work, • to rationalise the use of human resources, • to raise cost-efficiency and • to mobilise citizens
Implementation of adopted legislative (1) • Law on environmental protection 6 by-laws enacted • Law on air protection 8 by-laws enacted • Law on water protection 4 by-laws enacted • Law on waste management 6 by-laws enacted • Law on nature protection2 by-laws enacted • Law on Environmental Protection Fund Enactment of 10 b-laws has been currently undergoing the preparation phase Generally the enactment of sub-acts is late. The total of enacted sub-acts is about 60 %. In 2006 an enactment of rest sub-acts is to be expected (including both entities).
Functioning of enviromnetal monitoring sistem (1) NEAP (National Environmental Action Plan) • Priorities – Short- term: • INTRODUCTION OF INFORMATION SYSTEMS Projects for development and upgrading of databases( registries) • Supplying institutions with adequate equipment • INTRODUCTION OF MONITORING • Establishment of a central database, training of personnel and improvement of the existing communication with EEA • Establishment of a pollutant emission cadastre according to CORINAIR methodology • Emission and imission monitoring of large emitters • INTRODUCTION OF A WASTE MANAGEMENT SYSTEM • Elimination of wild dumpsites and rehabilitation of degraded areas • Identification of land destruction due to contamination by wastes and recovery of such areas
Functioning of environmental monitoring sistem(2) NEAP (National Environmental Action Plan) • Priorities – medium-term: • INTRODUCTION OF INFORMATION SYSTEMS • Establishment of a national environmental information system ( NEIS) • ESTABLISHMENT OF A RIVER BASIN MANAGEMENT SYSTEM • INTRODUCTION OF A WASTE MANAGEMENT SYSTEM • Adoption of the waste management strategy • Establishment of databases on wastes • Establishment of a waste market • Introduction of adequate pricing for disposal of all kinds of wastes in an environmentally sound manner • EDUCATION • Education and training programs related to collecting, proceeding and storing of date in accordance with modern methodology
Functioning of environmental monitoring sistem (3) NEAP (National Environmental Action Plan) • Priorities – medium-term: • BALANCED MANAGEMENT OF BIODIVERSITY AND LANDSCAPE DIVERSITY • Preparation of a strategy for biodiversity protection • Preparation and adoption of a Red List and red Book • PROTECTION REGIME • Preparation of programs for placing 15-20% of B&H territory under adequate protection regime
Functioning of environmental monitoring system(4) • “Establishment of a national environmental monitoring system- CARDS programm , current project • Provide adequate assistance to B&H when establishing monitoring and information system complying with the EIONET requirements • Institutional strengthening and capacity building in the field of environmental protection • Carrying out activities in selected sectors
Functioning of environmental monitoring system(5) International Convention to which B&H is a Party:: • Convention on long-range transboundary air pollution (Geneva 1979) • Vienna convention for the protection of the ozone layer (Vienna 1985) • United Nations framework convention on climate change (Rio de Janeiro 1992) • International plant protection convention (Rome, 1951) • (UN) Convention on biological diversity (Rio de Janeiro,1992) • The Ramsar Convention on Wetlands (Ramsar, 1971) • Convention for the protection of the Mediterranean Sea against pollution (Barcelona) • International convention for the prevention of pollution of the Sea by oil (London) • International convention from the prevention of pollution from ships (London) • Convention on co-operation for the protection and sustainable use of the River Danube (Sofija) • Basel convention on the control of transboundary movements of hayardous wastes and their disposal ( Basel 1989) • UN Convention to combat desertification in countries experiencing serious drought and/or desertification
Functioning of environmental monitoring system(6) IMPLEMENTATION OF ADOPTED LEGISLATIVE Conventions Currently undergoing the preparation process: • Convention on environmental impact assessment in a transboundary context (Espoo) • Convention on free access to information (Aarhus) Priority Directivese: • Water Framework Directive • Joint cooperation directive in the domain of accidental or intended sea pollution • Reporting Directive • Air quality framework directive and so-called Daughter Directives
Functioning of environmental monitoring system(7) B&H’s obligations in accordance with Ratification of certain Conventions and Directives According to the Conventions • Strategies and plans • legal instruments • monitoring • reporting According to the Directives • Defining strategic Directive priorities ( inclusion into the legislative) • Capacity building(With the EU assistance B&H is to chose leading countries that will provide adequate support in the domain of environmental technology)
