ASBOs regarding juveniles • 2 types • Civil ASBOs • Bolt-on ASBOs
Civil ASBOs • Civil cases • Brought by local authorities • No automatic ban – but section 39 can be imposed
Bolt-on ASBOs • If convicted at youth court for criminal offence, can apply for bolt-on ASBO • If application successful, can be reported • Magistrates have power to lift Section 49 automatic identification ban on criminal element if in public interest
Breaching an ASBO • Free to report • No automatic ban on identification in breach of ASBO cases • Magistrates can impose Section 39… but must state their reasons
