Right to Trial by Jury • 6th Amendment: guarantees the right to a trial by jury. • Juries are rarely used • Most criminal cases are resolved by guilty pleas • Juries are not required for certain minor offenses • Defendant can waive their right to a jury.
Right to a Speedy and Public Trial • 6th Amendment also guarantees the right to a speedy trial. • What does that mean?
Right to a Compulsory Process and to Confront Witnesses • Subpoena: court order requiring a witness to appear in court to testify. • Contempt of court: any act to embarrass, hinder, or obstruct the court in the administration of justice.
Freedom from self-incrimination • You cannot be forced to testify against yourself in a criminal trial.
Right to an Attorney • You will be appointed an attorney if you cannot afford one.
Criminal Appeals • If the verdict is “not guilty” the prosecution cannot appeal the decision. • If the verdict is “guilty”, sentencing will follow. • If a defendant is not happy with their guilty verdict they can ask the judge to overturn it or declare a mistrial. • Must convince the appeals court that there were serious errors of law made at tiral. • Writ of habeas corpus: defendant is being held illegally and requests release.
