Decree comprises 5 articles : - Article 1. Position and functions - Article 2. Tasks and powers

1. Government DECREE NO. 63/2012/ND-CP dated 31 Dec 2012 defining functions, tasks, powers and organizational structure of MOH Decree comprises 5 articles: - Article 1. Position and functions - Article 2. Tasks and powers - Article 3. Organizational structure - Article 4. Effectiveness - Article 5. Responsibility for implementation.

2. Article 1. POSITION AND FUNCTIONS MOH is a Government agency performing the function of State management on Health(providing care and protection of people’s health), comprising the following fields: - preventive health; - medical check-ups and treatment; rehab; - forensic examination, forensic medicine, psychological medicine; - traditional medicine and pharmacy; - Reproductive health; - pharmaceutical and beauty products; food safety; - health equipment; - health insurance; - population – family planning; - state management on public services in the fields under the Ministry’s state management scope.

3. Article 2. TASKS AND POWERS • GENERAL TASKS FROM 1 TO 4 - Basically the same as Decree No. 188/2007/NĐ-CP - Wordings have been amended and completed in compliance with the content stipulated in Gov. Decree No. 36/2012/NĐ-CP dated 18/4/2012. (formulation of legal normative documents, strategies, planning; guidelines for implementation)

TASKS RELATED TO SPECIALIZED FIELDS * Preventive health: supplemented in accordance with the Law on Prevention of Contagious diseases. - monitor diseases (contagious, non-contagious), - quarantine border health, - Publicize epidemic, publicize the termination of an epidemic, - promulgate list of contagious diseases for which vaccine must be used - Grant operational permits for vaccination establishments, certificate of biochemical standards for labs; - Issue the list of occupational diseases that are entitled to policies/benefits - Develop national technical standards and benchmarks on school health and sanitation, sanitation and quality of drinking water, water for daily use

5. Article 2. TASKS AND POWERS * Field of medical check-ups and treatment: (supplemented in accordance with the Law on medical examination and treatment). - develop National technical benchmarks on plastic surgery, - appraise, decide on the permission to apply new techniques, new methods first introduced in Việt Nam - Grant, suspend and revoke medical practice licence for medical examination and treatment and operational permits of medical check-ups and treatment facilities under authorized power - Appraise the specialized contents registering for advertisement of medical check-ups and treatment of health facilities under MOH, directly affiliated to other ministries, sectors and the foreign-funded health facilities.

6. Article 2. TASKS AND POWERS *The field of traditional medicine and pharmacy: (supplemented in accordance with the Law on medical check-ups and treatment). - issue Medical practice certificate and licence of eligibilities for traditional medicinal check-ups and treatment facilities, - supplement the content on appraising the specialized contents registering for adverts on traditional medicinal check-ups and treatment facilities, * The field of medical equipment: - Eliminated the content “receive the document publicizing the quality of medical equipment and products” and amended and supplemented it into “grant licence registering for circulation/sale of domestically-manufactured medical equipment” to be consistent with regulations on management of medical equipment.

7. Article 2. TASKS AND POWERS * In the field of pharmaceutical and beauty products: the following contents are added - grant certificate of eligibilities for the establishments performing the service to evaluate bioequivalence between drugs - Certificate meeting the standards of Current Good Manufacturing Practice (CGMP) for manufacturing cosmetics; - Template for receiving the dossier notifying good practice in cultivation and harvesting of medicinal plants; - Number for receiving the template for notification of cosmetic products and - Certificate of free circulation for units doing business in drug and cosmetics. - In particular, amending the content on management of drug prices: MOH only performs the state management on drug prices and uses measures to stabilize drug prices in the market under legislative regulations.

8. Article 2. TASKS AND POWERS + The field of food safety: Add new contents under regulations of the Law on food safety and Gov. Decree 38/2012/NĐ-CP (different from Decree 188/2012/NĐ-CP) - MOH is responsible to the Government for unification of state management on food safety - Manage food safety during the entire process of manufacturing, processing, preserving, transporting, exporting and importing and trading with regard to: food additives, process supporting substances, bottled soft drinks, natural mineral water, functional food, food that increases nutritious micro-substances.

TASKS AND POWERS + Training health human resources: amended, supplemented - Issue national technical benchmarks on conditions to ensure the quality of training health HR, guide and implement them; - Issue standards for professional capacity with regard to fields and specialized fields of education under the field of health (Amended Education Law and Decree 115/2010/NĐ-CP) + Management of public employees who are medical professionals: • Provide guidelines on identification of employment positions, structuring public employees according to occupational titles, the quantity of people working in public health facilities, - Develop standards for occupational titles; standards, conditions, contents, forms of taking exams, consider for increasing the level of occupational titles for public employees specialized in medicine, pharmacy, population; organize considerations and exams for level promotion

10. Article 2. TASKS AND POWERS + The field of health environment protection: amended and supplemented - Develop standards and norms on environmental protection in the health sector - Appraise strategic assessment report on environment and report on environmental impact assessment with regard to the projects under the power of ratification of MOH - Instruct, guide the implementation of such activities as: observation of health environment, environmental warning; management and control medical waste; make good of health environment pollution, recover health environment…. + In the field of medical science and technology: - amend and supplement the contents of this task to be consistent with legislative regulations on science and technology, moral standards in biomedical research; concerning management of technical standards and norms: concerning equipment

11. Article 2. TASKS AND POWERS *Information technology (IT):into a separate clause:(in accordance with Law on IT). - develop plan and planning for application and development of IT in the health sector - Formulate regulations on health activities online, - Establish technical norms and standards in application of IT in the field of health * Health communications and education: guide, implement, examine and monitor *National reserve on drug, chemicals, equipment * In the field of administration reforms: * In the field of management of profession associations:

Upgraded: + Dept of Science and Training into Administration of Technology Science and Training; + Dept of Traditional Medicine and Pharmacy into Traditional Medicine & Pharmacy Management 5. Re-organization of Legal Dep.; (in accordance with Decree 55/2011/NĐ-CP) 6. Re-structuring Representative office of MOH in HCMC into an organization under MOH Cabinet

15. Article 3. ORGANIZATIONAL STRUCTURE 7. Non-business units under MOH - Health Strategy and Policy Institute. - Health and Life Newspaper. - Practical Health Magazine. - Pharmacy Magazine. A total of 24 organizations (8 dept., 9 administrations, 1 General Office, MOH cabinet, inspectorate, 4 administrative/non-business units with state management functions) Dept of Organization and Personnel (3 offices), DPF (7 offices), HI Dept (3 offices), Dept of Medical Equipment and Construction (2 offices) Minister of Health shall submit to the Government PM to define functions, tasks, powers and organizational structure of the General Office of Population & FP, promulgate the list of other non-business units under the MOH.

16. Article 4. EFFECTIVENESS - This Decree takes effect as from 20/10/2012; - It replaces Gov. Decree on functions, tasks, powers and organizational structure of the MOH, and Gov. Decree No. 22/2010/NĐ-CP dated 09/3/2010 - Repeal previous regulations that are contrary to this Decree

17. Article 5. RESPONSIBILITY FOR IMPLEMENTATION Ministers, Vice Ministers of Ministerial-level agencies, Heads of agencies under Government and Chairpersons of People’s Committees of provinces and cities under Central control shall be responsible for implementation of this Decree./.
