The Election of 1800 • Problem with the election process • The man with the most votes became president, and the man with the second most became vice president • You could end up with a president and vice president from different political parties • EX: Adams (Pres.) & Jefferson (VP) • 12th Amendment • Separate ballots for the election of the president & vice president
Jefferson’s Policies • A large federal government threatened liberty • He wanted… • “A wise and frugal government.” • “The support of state governments in all their rights.” • He believed in the French philosophy of “Laissez-faire” • Means…… “allow to do” OR “let alone” • Repealed all internal taxes (including whiskey tax) • Tariffs remained • Cut the number of government workers • Reduced the nation’s debt
The Supreme Court • Supreme Court Cases and Precedents • Marbury v. Madison 1.) The Constitution is the supreme law 2.) The Constitution must be followed when it is in conflict with any other law 3.) Job of the Judicial Branch: uphold the Constitution and nullify laws that are unconstitutional • McCulloch v. Maryland • Congress is allowed to do more than the Constitution expressly authorizes it to do (expressed vs. implied rights/powers) • Gibbons v. Ogden • Federal law supersedes state law
Louisiana Purchase • Controlled by France and Napoleon • France was at war with Britain • Napoleon wanted to sell the Louisiana Territory to help pay for his wars with Britain • Jefferson bought the land from France for $15 Million • The Senate approved the purchase • Doubled the size of the United States • Was this Constitutional ??? • Jefferson rationalized it being constitutional under the treaties powers.
