  2. Special Exception Application Soil Extraction Use: LDC Chapter 3 allows soil extraction (borrow pit) uses by Special Exception only on property zoned Industrial-2 (IND-2). Special Exceptions are governed by LDC Chapter 2, Section 2.07. LDC Section 2.07 Special Exceptions approve a use that normally would not be appropriate within a zoning district, but if subject to appropriate limitations, conditions and safeguards, would promote the public health, safety, welfare, convenience and comfort. Special Exception approval criteria: In addition to the criteria of LDC 2.05.05, the following must be met: • Is consistent with the specific LDC requirements for that particular use • Meets LDC concurrency requirements • Is compatible with the surrounding neighborhoods and promotes the value of surrounding land, structures and buildings

LDC Compliance Findings LDC 2.05.05 and 2.07.03 criteria evaluation: • Not in conflict with public interest • Consistent with Comprehensive Plan • No significant financial hardship for the city • Does not create a public hazard or nuisance; must meet performance standards of LDC 4.03.03 for Soil Extraction activities • Future development must comply with all agency regulations • Is generally consistent with the use requirements of LDC Sec. 4.03.03 subject to adjustments through Technical Site Plan Review • Acceptable LOS standards to be maintained; negligible Peak Hour traffic generated; no development proposed other than borrow pit • Environmental impacts addressed through Palm Coast LDC, SJRWMD and ACOE requirements • Is compatible with surrounding Industrial uses and zoning districts

Staff Findings and Recommendation Findings Application #2862 complies with the requirements of the Comprehensive Plan and Sections 2.05.05 and 2.07.03 of the LDC, thus meeting the criteria to approve the requested Special Exception use. Recommendation Staff recommends that the Planning and Land Development Regulation Board approve Application #2862, a Special Exception for soil extraction use on the property, subject to final approval of the associated Comprehensive Plan Amendment and Rezoning applications.
