  2. Michigan’s Custody & Parenting Time Acts • Friend of the Court Act (552.501-552.535) • Child Custody Act (722.21-722.31) • Support and Parenting Time Enforcement Act (552.601-552.650) • Paternity Act (722.711-722.730) • Family Support Act (552.451-552.459)

  3. Friend of the Court Act • Requires the Friend of the Court to investigate and make written recommendations regarding custody and/or parenting time • Requires the Friend of the Court to initiate enforcement if a written complaint is made • Requires the Friend of the Court to provide alternative dispute resolution to assist parties in settling disputes voluntarily

  4. Child Custody Act • Best interests of the child • Presumed to be in the best interest of the child for the child to have a strong relationship with both parents

  5. Support and Parenting Time Enforcement Act • Provisions for enforcing parenting time order violations • Enforced against either parent • Remedies include • Make up parenting time • Commitment to county jail • License Suspension • Fines

  6. Paternity/Family Support Act • Provisions for custody and parenting time and referral to Friend of the Court

  7. Parenting time disputes • Statewide computer system allows for enforcement against either parent • ADR varies by county

  8. Parenting Time and Michigan’s Child Support Formula • The number of overnights with each parent is part of the formula • Parenting time has been part of the support calculation since 2008 • Prior to 2008 there was a support abatement after a set number of overnights; usually 50% after 7 consecutive overnights

  9. Our Local Process • 18 Family Counselors – licensed social workers • Domestic violence screening • Meet with parties to resolve custody/parenting time issues pre & post judgment • Pre-judgment privately filed actions for divorce & custody – parties attend our SMILE program
