  2. Violations of NCAA Rules • Violations of NCAA rules come in two primary types: • Major Infractions • Secondary Violations • Secondary Violations are isolated. • Secondary Violations are inadvertent. • Secondary Violations do not involve findings of “failure to monitor.”

  3. Types of Secondary Violations Level 1 Level 2 SECONDARY VIOLATIONS

  4. Differences Between the Levels Level 1 Level 2 Viewed as the least serious of all types of violations. Examples: Some minimal recruiting violations (e.g. certain mistakes involving printed materials and phone calls) Impermissible benefits to student-athletes of less than $100 Bylaw 17 violations • Viewed as more serious than Level 2 (more likely to result in a recruiting advantage or competitive advantage). • Examples: • Most recruiting violations • All eligibility violations • Nearly all financial aid violations • Impermissible benefits to student-athletes of more than $100

Virginia Tech Procedures for EvaluatingPotential Violations 1) The compliance office receives information regarding a potential violation (usually as a self-report). 2) Compliance staff members gather facts from involved parties. In all cases, the Faculty Rep stands available to assist in these fact-finding efforts. 3) Compliance staff members review relevant legislation and interps, and consult with ACC and/or NCAA staff members as necessary, to determine whether a violation occurred. 4) Once confirmed, the violation is classified as a Level 1 or Level 2.

Virginia Tech Procedures – Level 1 5) Upon determination that a Level 1 violation has occurred, the following persons are notified: AD, Faculty Rep, sport supervisor, individual who committed the violation, and head coach (if the violation was committed by an assistant coach or a student-athlete). 6) Case precedent is reviewed to determine appropriate options for corrective actions. 7) Conversation occurs with the involved coach, head coach (if the involved coach is an assistant), and sport supervisor. Recommended corrective actions are chosen. 8) A report letter is drafted; it is reviewed with the AD and sport supervisor.

Virginia Tech Procedures – Level 1 9) The report letter is finalized and sent to the NCAA Office in Indianapolis. 10) Level 1 reports are copied to the following individuals: • President • Faculty Rep • AD • SWA • sport supervisor • head coach of involved sport • involved individual (coach, student-athlete, etc.) • ACC staff

  10. Virginia Tech Procedures – Level 2 10) Summary information is compiled on a form developed by the ACC, and forwarded to the ACC Office quarterly (Oct. 31, Jan. 31, April 30, July 31). We call this form “the grid.” 11) Level 2 quarterly compilations are copied to the following individuals: • President • Faculty Rep • AD • SWA
