  2. Knowledge transfer and IP management The aim is to ensure effective knowledge-sharing. Key Challenges: • Public research organisations (PROs), including universities, should better exploit and valorise publicly-funded R&D results through: • Stronger R&D collaborations with enterprises • More active KT activities (licensing, spin-offs) • Intellectual property (IP) generated by PROs should be managed more effectively Response to challenges: • Improving (transnational and international) knowledge transfer between PROs and the private sector by promoting coherence between national knowledge transfer systems

Knowledge transfer and IP management • Recommendation to Member States promotes key principles for improving national intellectual property (IP) and knowledge transfer policies • Code of Practice offers guidance for PROs to set up institutional policies and knowledge transfer systems • List of best practice examples for Member States to support implementation of the recommendations (Annex II)

Code of Practice for universitiesand other public research organisations • Principles for an internal intellectual property (IP) policy for effective management of their own IP(policy, rules, procedures, incentives, awareness, training, …) • Principles for a knowledge transfer (KT) policyfocusing on active transfer and exploitation of IP(exploitation strategies and policies, including for licensing and spin-offs; access to professional KT services; sharing of financial returns; monitoring of KT activities) • Principles regarding collaborative and contract research (basic principles for IP ownership and access rights)

Knowledge transfer and IP management Next Steps • Commission and Member States: CREST group to monitor and evaluate the take-up and impact of the Recommendation and Code of Practice; exchange best practices; develop guidelines. • Member States will inform the Commission by July 2010 and every two years thereafter of measures taken on basis of the Recommendation. • Commission study to monitor implementation and impact of the Recommendation and Code of Practice • Commission and Stakeholders: Thematic Forum on Knowledge Transfer to discuss implementation of the Code of Practice and exchange best practices. • Member States events: to discuss national implementation of Recommendation and Code of Practice, actions to develop national policies and guidelines. • Bilateral agreements with stakeholder organisations to cooperate on future knowledge transfer initiatives. • Stakeholder events: to disseminate and endorseCode of Practice, responsible partnering
