Presentation Outline • Overview • Legislative Requirements • 2020-2011 CIE Update • Summary • Policy Amendments • Interlocal Agreement • Requested Action
Overview • Capital Improvements Element • Required element in the Comprehensive Plan • Designed to consider the need for, and location and timing of, public facilities • Ensures public facilities will be available and adequate to provide acceptable levels of service (LOS) • Ensures that the Comprehensive Plan is financially feasible
Overview • Concurrency • The premise of concurrency is that public facilities and services will be available concurrent with the impacts of development • Local government sets LOS standards, and concurrency ensures that those LOS standards will be achieved and maintained
Overview • Level of Service (LOS) Standards • Identified for concurrency-related facilities • Parks and recreation • Roads • Schools • Solid waste • Stormwater • Water and wastewater • Provide a quantitative tool to analyze the impacts of land use changes
Overview • Financial Feasibility • Must demonstrate ability to achieve and maintain adopted LOS standards • For any facilities required to achieve LOS: • Projects in FY1-FY3 must be funded through a committed funding source • Projects in FY4-FY5 may be funded by committed or planned sources
Overview • Funding Sources • Committed funding source: An existing source and amount of revenue presently available to a local government • Planned funding source: A revenue source not currently available, such as a potential grant
Overview • Capital Improvements Element • Includes • Location and timing of needed facilities • Principles for construction, extension or increase in facility capacity • Principles for correcting existing deficiencies • Estimated costs and projected revenue sources • A capital improvements schedule (CIS) that ensures that adopted LOS standards are achieved and maintained
Overview • Capital Improvements Element • Data and Analysis • Goals, Objectives and Policies • Capital Improvements Schedules
Overview • Capital Improvements Element • Data and Analysis • Projected public facility demand • Levels of service for public facilities • Summary of revenues and expenditures • Identification of any deficiencies
Overview • Capital Improvements Element • Goals, Objectives and Policies • Plan for and manage public facilities to adequately serve existing and new residents • Require maintenance of adopted LOS standards • Coordinate development approval with the Capital Improvements Program • Require future development to bear its fair share cost for facility improvements • Maintain a Concurrency Management System
Overview • Capital Improvements Element • Schedules • For each concurrency-related facility • Capital Improvements Schedule • 10-Year Facilities Work Plan • OCPS District Capital Outlay Plan • Long Term Concurrency Management Systems (LTCMS)
Presentation Outline • Overview • Legislative Requirements • 2020-2011 CIE Update • Summary • Policy Amendments • Interlocal Agreement • Requested Action
Legislative Requirements • 2005 Growth Management Legislation • Enacted penalties for not adopting an annual update of the Capital Improvements Element (CIE) by December 2008 • CIE and Capital Improvements Schedule (CIS) must demonstrate financial feasibility
Legislative Requirements • 2009 Growth Management Legislation • Delayed the CIE requirements to December 2011 • County’s update continued to meet the financial feasibility standards during the grace period • Department of Community Affairs (DCA) currently reviews CIE under the guidelines provided in 2009
Legislative Requirements • 2011 Legislative Proposals • Further delay annual update requirement to 2013 • Remove financial feasibility requirement • Allow annual adoption at local level (no state review) • Remove state-mandated concurrency for transportation, schools and parks
