Overpayments / Veterans Options Presented By: Tom Meadows
Proposal to create an overpayment • May challenge the proposal • May request personal hearing • No Notice of Disagreement at this time
Examples: • Receipt of SS in a NSC Live/Death Pension case • VA proposes to count income from effective date of SS award • Challenge VA proposal. Income should only be counted from 1st of the next month following actual receipt of SS • Proposal to reduce vets compensation while vet is on active duty Vet already reduced
Vet/beneficiary Options once Overpayment is established • Contest debt • Request Waiver within 180 days • 5655 required • If waiver requested within 30 days collection of debt is suspended pending waiver decision • Request Hearing • Request repayment plan • Compromise offer • Loan Guaranty Debts
Medical Care Issues • Co Payment Debts • Will be collected from VA, SS, Tax Returns • Request Hardship Waiver on a Quarterly Basis 5655 required • Hardship Waiver for entitlement to Health Care • Current entitlement for 2013 based on 2012 income • Vet income clearly over limit in 2012 laid off Dec 2012 • Income for 2013 only $20,000
Income Verification Match • Currently reviewing 2011 reported income on 10-10EZ or10-10EZR • Vet notified of discrepancies with reported income versus IRS Match • Vet can either challenge or accept IRS findings • May result in Overpayment being created • Vet may lose entitlement to Health Care • Vet will have right to request a Waiver/Compromise • Don’t send money with compromise offer
