Background & Overview • Memorial & Sacred Heart Hospitals closed in November 2009 • Created a Zoning challenge to encourage adaptive reuse • Current zoning classifications not designed to foster mixed use redevelopment • Plan amendment was initiated to evaluate & address this issue • Plan amendment was adopted on October 26, 2010 • Plan Amendment recommended adoption of a new Floating Zone • Apply to properties at least 2 acres in size • Must contain one or more principal use structures with at least 50,000 S.F. of floor area • Must require a mix of land uses to redevelop • Staff worked with Memorial Hospital redevelopment manager to create the proposed Adaptive Reuse Floating Zone

Proposed ZTA Features • Amends Sections 5 & 6 of the Zoning Ordinance • Creates a new Mixed Use Zoning District • Can be applied to any current Zoning District • Properties must satisfy the basic eligibility criteria • Requires submission & approval of a Master Comprehensive Redevelopment Plan for the project • Allows Rezoning, Site Plan, & Subdivision Plat to be reviewed/approved concurrently in a one-stop process • Ensures all special approval processes are secured before final approval of project • Process requires public hearings before approval

Procedural History • Comprehensive Redevelopment & Adaptive Reuse Plan Amendment adopted on October 26, 2010 • Draft Adaptive Reuse Floating Zone ZTA presented to Planning Commission on January 10, 2011 • Planning Commission conducted a public hearing on the draft ZTA on February 14, 2011 – No public comments received • Planning Commission approved a unanimous recommendation of approval to the Mayor and Council on February 14, 2011 • First Reading of ZTA adoption ordinance was approved by Mayor and Council on March 15, 2011 • Final public hearing on ZTA scheduled for April 12, 2011

  5. Special Application Fee • Staff recommends adoption of a new fee for Adaptive Reuse Floating Zone Applications • Fee recommendation based on new proposed zoning & planning fee structure • Proposed fee structure: • Basic Fee For All Applications - $600 • Plus $50 per lot for any subdivision exceeding 5 lots • Fee would be due in total at time of application filing • ½ of fee can be refunded prior to PC hearing legal ad submission • ¼ of fee can be refunded prior to PC decision • No refund after PC recommendation to Mayor & Council
