  3. EMPLOYMENT CONTRACTS It is a legal relationship that calls for one individual to be paid for working under another direction and control. The person who pays someone is the employer and the person who is being. paid is the employee.

  5. EMPLOYMENT DISCRIMINATION • Legal: • choosing the best person for job • achieving efficient production • Illegal: • hiring • firing • promotion • awarding of Benefits etc. based on race, color, gender, age, religion, etc.

  6. FORMS OF SEXUAL HARASSMENT Quid Pro Quo- one thing is exchanged for another. The most vivid illustration of this is when the boss threatens to fire a subordinate unless the subordinate provides sexual favors. However, the employee must identify a specific employment practice and show statically that the practice excludes members of a protected class. Hostile Environment arises when unwelcome sexual comments, gestures, or contact interfere with an employee's ability to work..

LEGAL TERMINOLOGY • Employer: The party who pays someone in order to direct and control that person's activities. • Employee: The party who is paid by the employer to serve under the employer's direction and control id the employee. • Wrongful Discharge: When an employer fires an at-will employee for one of the above reasons. • Unemployment Compensation: Money paid by the government or a private insurance fund to workers who have lost their jobs through not fault of their own.

  8. MAKING AND TERMINATING EMPLOYMENT CONTRACTS • Making • Express agreements between the employer and employee • Implied agreements between the employer and employee • State and federal laws • Terminating • By performance • Termination at will • Wrongful discharge • Violation of contract terms

  9. STRIKES • Economic Strikes. • These are strikes over wages. • Workers can be replaced by permanent replacements. • Unfair Labor Practice Strikes. • These are strikes alleging that the employer has committed an unfair labor practice.
