Lawsuit claims iPod Nano scratches easily Shoneca Evans October 27, 2005
Consumers have filed a proposed class action lawsuit claiming the Nano scratched "excessively during normal usage" Consumers claim that Apple released the product with knowledge that the film of plastic resin that covers it was not as thick or strong as the previous iPod products. Apple concealed the defect and advised class members that they would need to purchase additional equipment to prevent the screen from scratching excessively Apple admitted in late September that some iPod Nano screens cracked too easily, but blamed that separate issue on vendor quality problems and said it had occurred in less than one-tenth of 1 percent of the Nano sold at that point IPOD NANO
IPOD NANO • The named plaintiff in the lawsuit is Jason Tomczak, who bought a Nano in September. He said that it quickly became so scratched he could not view the screen. • Apple replaced that device because of a battery problem, but the complaint said the replacement Nano also became so scratched that Tomczak decided to return it.
IPOD NANO • Does anyone in the class own an iPod Nano? • If so, have you had this problem with it? • Is anyone thinking about getting an iPod Nano? • If you had an iPod Nano and this problem had happened to you, would you sue Apple? • Has anyone’s opinion of Apple’s integrity and character changed after hearing about this lawsuit?
