OVERVIEW OF RELEVANT LEGISLATION Agricultural Products Standards Act, 1990 (Act No 119 of 1990) (APS ACT) “To provide for control over the sale and export of certain agricultural products, control over the sale of certain imported agricultural products; and control over other related products; and for matters connected therewith”. Export Regulations  Prohibitions on the export of a particular product - Approval by the Executive Officer - Certification: Conducted by the PPECB - Exemptions e.g. countries, consignment size, purpose etc.  Application for approval for export  Procedures for inspection  Approvals and rejections  Appeals  Export Standards & Requirements  Regulates the export of certain agricultural products  Approved by the Executive Officer 6

EXPORT STANDARDS AND REQUIREMENTS - QUALITY Scope includes the following: Packing & Container requirements Labelling/Marking requirements, e.g. True description of contents Grade indication Packing medium Country of origin Physical address of packer/manufacturer Quality standards for classes or grades (Grades, e.g.: Choice, Standard, Substandard) Permissible deviations from standards (e.g. Uniformity, colour, blemishes, preparation)

FOOD SAFETY ▪Standards Regarding Food Hygiene and Food Safety of Regulated Agricultural Food Products of Plant Origin Intended for Export (Notice 707 of 13 May 2005) Food safety requirements for animal products handled under Directorate: Veterinary Public Health Food business operators (FBO’s) shall ensure that all stages of handling for which they are responsible, from and including primary production up to and including the export of food products are carried out in a hygienic way in accordance with the prescribed requirements of this Standard FBO’s = producers, packhouses, factories, silos, transporters, stores and cold stores, i.e. everyone in export supply chain

  10. FOOD SAFETY continued For export to all countries FBO’s are audited by PPECB Recordkeeping and Traceability is a requirement FBO must register with the Executive Officer (APS Act) - Rooibos and Honeybush tea - Factory code for canned and frozen products, dried fruits

ENFORCEMENT OF LEGISLATION PERISHABLE PRODUCTS EXPORT CONTROL BOARD (PPECB) Appointed Assignee since 1991 Carries out inspection on various products destined for export Undertakes food safety and food hygiene audits based on risk Evaluate labels for compliance with prescribed marking requirements

HANDLING PROCEDURES FOR NON-COMPLIANCES In terms of rejected consignments: The PPECB notifies The exporter/processor/packer concerned The DAFF (and DAFF’s laboratory where applicable) The Directorate Inspection Services informs the DoH (D: Food Control) when necessary Shipped consignments – shall either be recalled or destroyed
