Summary • The Division is requesting proposed changes through temporary rulemaking to rules 15A NCAC 13A .0101-.0102, .0106-.0113, .0118-.0119 to remove references to requirements which would otherwise automatically become effective through the federal Hazardous Waste Generator Improvements Rule on May 30, 2017. • This temporary rulemaking action will allow the North Carolina hazardous waste regulatory program’s current rules to remain intact until permanent rulemaking is completed for the federal regulation so all parts of the new regulation are effective at one time (anticipated March 1, 2018).
Public Comment Period Department of Environmental Quality • Public Comment Period: March 10, 2017 to April 7, 2017 • Proposed temporary rule amendments were posted on the OAH website and on DEQ & HWS webpages • Emails were sent to interested parties and stakeholders • Public Hearing was held on April 3, 2017 • No one other than Division staff attended • One comment was received during the public comment period for the proposed rule changes • The comment acknowledged support of the proposed temporary rule changes
Recommendation Department of Environmental Quality The Division recommends that the EMC approve the Hearing Officer’s Report and adopt the proposed temporary amendments to rules 15A NCAC 13A .0101-.0102, .0106-.0113, .0118-.0119.
