EBSA Overview • The mission of the Employee Benefits Security Administration is to assure the security of the retirement, health and other workplace related benefits of American workers and their families.  We will accomplish this mission by developing effective regulations; assisting and educating workers, plan sponsors, fiduciaries and service providers; and vigorously enforcing the law. • Phyllis C.   3. EBSA Goals EBSA supports the following Department of Labor Strategic and Outcome Goal: • DOL Strategic Goal: Secure health benefits and, for those not working, provide income security. • EBSA Outcome Goal: Improve health benefits and retirement security for all workers.

EBSA Results • We are measuring results differently. • EBSA performance measures have evolved over the years both prior to and after the passage of the Government Performance and Results Act: • Output measures (e.g. # of cases closed) • Effectiveness measures (e.g. % of investigations closed with results) • Outcome measures (e.g. compliance rates in selected, discrete program areas) • Customer satisfaction scores. • EBSA is now exploring opportunities to expand on compliance studies, develop recidivism measures in discrete areas, and re-evaluate participant assistance satisfaction.

EBSA Results • How will we measure success? • Civil Ratio: % of cases with a positive result (fiduciary violation) • Criminal Ratio: % of cases accepted for prosecution • We will re-evaluate participant assistance program customer satisfaction to ensure that we are maintaining our World Class participant assistance program. • For the first time, in FY 2010, we will analyze recidivism rates in selected program priority areas. • Outcome? Efficient and effective enforcement program that engenders long-term compliance and a World Class participant assistance program.

  6. EBSA Strategies • EBSA will continue to vigorously enforce the law; assist and educate workers, plan sponsors, fiduciaries and service providers; and develop effective regulations. • We are using new approaches. • EBSA has instituted new strategies to achieve our mission including a Health Care Compliance Check Sheet, a new Contributory Plan Criminal Project (CPCP), and rulemaking to expand the term “fiduciary” as it relates to investment advisers.
