  2. Article 2 Section 1: The Presidency • Terms of Office: 4 years • American voters DO NOT choose the President directly. • Members of the group called the ELECTORAL COLLEGE actually elect the President.

  3. Article 2 Section 2: Powers of the President • The President is the Commander in Chief of the Army and the Navy. • Is able to make treaties and appoint ambassadors with the advice of the Senate and with 2/3 Senate approval. • Appoints Supreme Court Judges

  4. Article 2 Section 3: Presidential Duties • Gives the State of the Union Address • He may ask both the House and the Senate to get together and work things out if there is a big disagreement. • He receives ambassadors from other countries. • He makes sure the laws are executed faithfully.

  5. Article 2Section 4: Impeachment • The President, Vice-President, and all civil officers may be removed from office on impeachment for the conviction of: treason, bribery, and other high crimes.

  6. Article 3: The Judicial Branch • The Judicial branch INTERPRETS the laws and rulings can shape government policies on hotly debated issues.

  7. Article 3 of the Constitution also guarantees a trial by jury to ALL persons accused of crimes in a federal court, except in cases of impeachment.

  8. Article3: Section 1Federal Courts and Judges • The judges of the Supreme and inferior courts will hold the office for life, as long as they behave. Judges can resign if they want.

  9. Article 3: Section 2The Courts’ Authority • The Judicial Branch’s checks on Congress would be the Judicial Review (see page 245 chart on Checks and Balances). A Judicial Review can declare acts of Congress as unconstitutional. In other words, the Supreme Court can decide whether or not a law violates the Constitution through a Judicial Review.

  10. The Supreme Court has appellate jurisdiction. This means that they have the power to review lower courts decisions and change the results of the decision.

  11. Section 3: Treason • Treason is defined as levying was against the united States, helping enemies of the U.S. by giving them aid and comfort. In order to be convicted of treason, there needs to be the testimony of two witnesses to the same overt act, or on confession in open court. • The Framers of the Constitution knew that in England, people could be tried of treason for their thoughts or words. The Framers made sure that there was a high standard of proof.
