What is Proposition 39? • Requires that schools districts provide facilities to house charter schools if they submit appropriate application materials justifying enrollment, etc. • District only required to house charter schools’ “in-district ADA” (So if a charter school has a lot of students from outside of SDUSD, we don’t have to provide space for them). • District must provide space to charters that is “..reasonably equivalent” to that provided to district schools (including furniture and basic equipment)
What must the District do? • State-adopted regulations for Prop. 39 • November 1: Prop. 39 applications were due • By December 1: District must respond to charter schools’ ADA projections • January 2: Charters respond to District’s concerns over projections • By February 1: Make preliminary offers to charter schoolsNote: Charter schools may or may not accept the offers made.
What happens next? • Charters have until March 1 to express objections/concerns with the preliminary offers. We will ask charters to indicate as early as possible in February if they wish to pursue the offers (they’re under no obligation to tell us until March 1) • If there is interest by the charter school, we will work with Area Superintendents, Principals and the community on how to accommodate and develop sharing arrangements. • By April 1, we must make “Final Offers” to charter schools. • Occupancy would be in mid-August, 2013.
