  2. Americans with Disabilities Act (ADA) • The ADA of 1990 provides individuals with disabilities access to: • Employment (Title I) • Public Services & Transportation (Title II) • Public Accommodations (Title III) • Telecommunications (Title IV) • Other Provisions (Title V)

Americans with Disabilities Act (ADA) • The ADA defines an individual with a disability if the following criteria are met: • a physical or mental impairment that substantially limits one or more major life activities of such individual; • a record of such an impairment; or • being regarded as having such an impairment

  4. Americans with Disabilities Act (ADA) • The ADA requires that individuals with a disability be otherwise qualified for the job, program, or activity for which access is sought. The law prohibits exclusion of individuals from jobs, services and activities or benefits based on disability. • The individual must be able to perform the essential functions of the job or meet the essential eligibility criteria of the program, with or without reasonable accommodation. • The law includes penalties for non-compliance.

  5. Americans with Disabilities Act (ADA) • Requesting Accommodations • Requests for accommodation may be for a current position or a position for which the qualified individual is applying. Applications for ADA accommodations must be filed with the Director in the Human Resources Department. • After reviewing documentation of each request, the Director of Human Resources will determine if the employee is eligible for accommodation under the ADA.

Americans with Disabilities Act (ADA) Grievance Procedures • Prepare a written statement • Detail the allegations • Deliver written statement to appropriate University administrator • Vice President for Business Affairs • Vice President for Academic Affairs • Human Resources Director/Equal Employee Opportunity (EEO) Coordinator
