Policy – Oversight - Implementation Legislation Impacting SAPR Program • FY05 NDAA, Sec 527 SECDEF is required to conduct annual surveys on sexual assault and harassment at the Military Service Academies. Defense Manpower Data Center (DMDC) conducts the annual Service Academy Gender Relations Survey • FY05 NDAA - Oct 04 – H.R. 4200 became Public Law 108-375: Section 577 requires Services to prescribe regulations, or modify current regulations, on the policies and procedures on the prevention of and response to sexual assaults involving members of the Armed Forces, and to submit an annual report. • FY06 - H.R. 3402 bill became Public Law No: 109-162 H.R. 3402[109]: Violence Against Women and Department of Justice Reauthorization Act of 2005 – NOTE: New UCMJ Sexual Assault Definition effective 1 OCT 07 • FY06 NDAA - HR1815 - Section 596 (improvement to the Department of Defense Capacity to Respond to Sexual Assault Affecting Members of the Armed Forces) of the NDAA for FY 2006 (Public Law 108-163) • FY07 NDAA - HR 5122 - Sexual Assault: • Sec 532. Revision And Clarification Of Requirements With Respect To Surveys And Reports Concerning Sexual Harassment And Sexual Violence At The Service Academies • Sec. 583. Army Senior Leaders • Scope: Provides the Senior Leader with the Knowledge, Awareness, and Prevention Techniques Regarding Sexual Assault That They Can Apply to Their Daily Leadership Responsibilities, and Personal Lives. • NOTE: TRADOC Authorized the IMI alternative training method in lieu of Intermediate and Senior Level Instructor-Lead SAPR TSP Course at times when TSP did not fit into the training schedule.

Training and Awareness National Guard Bureau Training Program • NGB video - “Sexual Assault: Staying on Guard” - initial SAPR training and can be used to meet an annual refresher training requirement if new training has not been provided by NGB • CD contains a 36-minute video,a resource list, and reporting option handouts from the NGB Joint Forces SAPR Program • The video provides viewers with a clear understanding of sexual assault, myths and facts regarding sexual assault, prevention and response policies, Soldier (victim) status (Title 10 versus Title 32) implications, and an appreciation of leadership’s total commitment to this program. • NGB receives SAPR training in all TRADOC institutional training

Training and Awareness Combat Readiness Center (CRC) Program Awareness and Risk Management Products • Integrated SAPR training into the Commander’s Safety Course and in FM 5-19 (FM 100-14) Composite Risk Management (Jul 06) • Created a Sexual Assault Prevention web page providing Commanders information on how to use Composite Risk Management (CRM) to conduct a comprehensive risk assessment and take appropriate steps to prevent or eliminate the risk of sexual assault within their command • Incorporated Sexual Assault Prevention in Jan 06 CRC Magazine issue

Reporting and Program Assessment Program Reporting and Assessment • G-1 SAPR Office produces the following sexual assault reports: • DoD SAPRO and J-1: Monthly CENTCOM report statistics and StratCom only • DCS, G-1: Monthly CENTCOM Smart Book report – statistic and analysis • DoD SAPRO: Quarterly Army-wide report – statistics and StratCom only • SecArmy: Quarterly Army-wide report with statistics and analysis • Congress, SecDef, SecArmy: Annual Army-wide Report – analysis, annual assessment, case dispositions, statistics, and StratCom • Senior Mission Commanders and/or Installation Commands hold monthly Sexual Assault Review Boards to review the command’s sexual assault case management and assessment operational processes to address issue and implement program improvements. • As required, SARB members include installation or Deployable SARCs and medical, investigative, legal, law enforcement, and unit commanders

Future Program Requirements • AR 600-20 Rapid Revision – Requirements – Effective 18 Apr 08: • Commands must conduct an annual program assessment – provide results to HQDA • Special Court-Martial Convening Authority or General Court-Martial Convening Authority - review all administrative separation actions involving victims of sexual assault • New procedures for Sexual Assault Forensic Exam (SAFE), Collection, and Preservation of Evidence under Restricted Reporting • Way Ahead: • SAPR Phase II Action Plan – 128 Actions based on DCS, G-1 guidance, DAIG program inspection findings/recommendations, congressional and DoD oversight requirements, & lessons learned – Currently coordinating with ARSTAF/Commands • OCONUS Sex Offender Registry – Policy and Action Plan • DoD Program Policy/Execution Standards • Congressional Report Actions: • Government Accounting Office Program Review • DoD IG Evaluation • Per legislative requirement in FY06 NDAA, the Defense Task Force on Sexual Assault in the Military Services (DTF-SAMS) will visit Army installations beginning in third quarter FY07 to assess DoD/Service SAPR Program implementation. • DoD SAPRO Assessment of Services’ SAPR Programs17
