Presentation Outline • Introduction • Reponses to the comments of the PCOT on the proposed legislative amendments
Introduction • Purpose of the presentation is to provide the response to the issues raised by the Portfolio Committee on the proposed amendments to the National Road Traffic Regulations.
Continued • AD Regulation 13A Comments by PCOT: “that proposed regulation does not have unintended consequences to the second hand genuine car parts” by prohibiting the sale of these parts. • Solution by DOT: Regulation 13A is to be amended to insert a proviso clause which provides that the provision of Regulation 13A does not apply to parts of motor vehicles which has been deregistered as a result of such motor vehicle not being fit to be operated on a public road. The proposal will ensure that parts of deregistered motor vehicle other than those of compacted motor vehicles are able to be used or sold.
Continued • AD Regulation 13A Comments by PCOT: “Regulation of the Driving Schools will performed by what Authorities within the three spheres of government”. • Response by DOT: The registration of driving Schools will be done by the various MEC’s responsible for Traffic at provincial level. The requirements for the registration will be based on standardised requirements and uniform training applicable across the Republic.
Continued • AD Regulations Comments by State Law advisor: “that proposed regulations refers to dates that have already passed therefore imply that they will have retrospective application. • Response by DOT: Since the Regulations were published in 2012 it was envisaged that consultation would be finalised by the time as contained in the regulations the dates have been amended to ensure that they have no retrospective application. NB : Dates will be amended to ensure that all stakeholders have adequate time to comply with the regulations.
Continued • AD Regulations 149A Comments by State Law advisor: “that the proposed regulation refers to a date which has already passed therefore imply that they will have retrospective application. • Response by DOT: The initial provision of the Regulations as contained the Regulations is not amended, the regulations are amended to ensure that it caters for new motor vehicle that have been manufactured by Manufacturers of motor vehicles with an anti-theft braking device. NB : The provision does not have a retrospective application as relates to new motor vehicles that have been manufactured with such a devices and its operation is electronically controlled.
