Costs of Alcohol Abuse in Victoria • From 2002-04 a major factor in : • 2,879 deaths • 15,465 family incidents • 9,000 emergency hospital admissions • 9,945 assaults* • 18% of Vic road vehicle deaths in 2006 over .05 • 60% pedestrian deaths during high alcohol times • Each month 300,000 young Victorians binge drink * Victorian Alcohol Statistics Handbook 2
S.108 Liquor Reform Act A licensee must not: • Supply liquor to a person in a state of intoxication. • Permit drunk or disorderly persons on premises. Penalty $6,607 “On-the-Spot” (10% of $6,607) = $661 Intoxicated …if speech, balance, co-ordination or behaviour is noticeably affected and there is reasonable grounds for believing that this is a result of the consumption of liquor. 3
S. 114 Liquor Reform Act • A person who is drunk, violent or quarrelsome must not refuse to leave licensed premises when requested to do so by licensee, employee or police. Penalty $2,202 4
Can Licensee Allow Minors On Premises ? NO! Unless • in the company ofa responsible adult, or • they are partaking in a meal, or • they are a resident, or • they are employed in duties other than the supply of liquor,or • entertainment for persons under the age of 18 with Director’s approval, or • it is an “on-premises” licence with restaurant conditions. 5
Definitions • Responsible adult –a spouse, parent, step-parent, guardian or grandparent, or a person who is acting in place of a parent and who could reasonably be expected to exercise responsible supervision. • Spouse – a person to whom the person is married. • Guardian –a person authorised by law to manage their affairs. 6
Can a licensee supply liquor to a minor ? No! Unless: • partaking of a meal and with a spouse (over 18 years of age), parent or guardian • a minor may beemployed to deliver packaged liquor to a person over 18 years of age 7
Can Licensee Supply Liquor To A Minor? • Defence: -they have sighted an evidence of age document:*Australian Driver’s Licence *Victorian Learners Permit *Passport *Proof of Age Card *Keypass Card 8
Supplying Liquor To A Minor Penalties: • Licensee $6,607 • Employee $1,101 • Other person $6,607 9
Other Offences • A person must not send a minor to obtain liquor ($6,607) • A licensee must not permit a minor to supply liquor ($6,607) 10

RSA Strategies Server • Discourage intoxication. • Promote non-alcoholic beverages and food. • Promote safe transport alternatives. Manager • Prohibit employees from drinking on job. • Market responsible business practices. • Train staff. • Maintain adequate staff numbers. • Written policies & procedures for staff. • Enforce policies & procedures. • Hire qualified staff. 12

Common Drinks • Pot of beer - 285ml (4.9%) = 11 grams • Bacardi Breezer -275ml (5.6%) = 12 grams • Wine-100ml (12%) = 10 grams • Spirits - 30ml (40%) = 9 grams • Port - 60ml (18%) = 9 grams 14
Advantages – Light Beer • less tax for licensee • more can be sold with patron remaining under .05 • less problems associated with intoxicated patrons. 18
If RSA is a condition of licence • licensee must produce evidence of completion, if requested by police. Penalty $551 19
