Action Plan/Objectives • Overview/inventory on the re-registration procedures and the implementation of the information exchange according to Directive 1999/37/EC (registration documents for vehicles) in the different MS • Standardization of the information exchange according to 1999/37/EC • Best practice guidelines (BPG) for re-registering vehicles and implementation of Directive 1999/37/EC in consideration of “Commission interpretative communication on procedures for the registration of motor vehicles originating in another Member State” (2007/C 68/04) • Recommendations for adjustments/changes of Directive 1999/37/EC
Problem definition • Directive 1999/37/EC on the registration documents for vehicles • Information exchange regarding re-registration of vehicles • Notification of re-registration (Art. 5 (2)) • Request for confirmation of entitlement to re-register a vehicle (Art. 5 (2), 2nd paragraph) • Check before re-registration (Art. 9) • Different re-registration procedures in the Member States
Notification of re-registration (Art. 5.2) • With a view to re-registering a vehicle previously registered in another Member State, the competent authorities shall • require the submission of Part I of the previous registration • certificate in every case and of Part II if it was issued • withdraw the part(s) of the previous registration certificate • keep the latter for a minimum of 6 months • within 2 months inform the authorities of the Member State • which delivered the certificate of its withdrawal • return the certificate which they have withdrawn to those • authorities if they so request within six months
Problems/bottlenecks (1) • not all MS send notifications on re-registered vehicles • some MS send incomplete notifications • MS uses different formats/ways of information exchange • paper (e.g. UK, NL); no automatic processing possible • different file formats and structures • sometimes de-centralised (e.g. I, A) • different frequency of sending notifications • not in all MS “automatic” de-registration after receiving a • notification • need to standardize the information exchange!
Request for confirmation (Art. 5.2, 2nd paragraph) Where the registration certificate consists of Parts I and II, and Part II is missing, the competent authorities in the Member States where the new registration has been requested may decide, in exceptional cases, to re-register the vehicle, but only after having obtained confirmation, in writing or by electronic means, from the competent authorities in the Member State where the vehicle was previously registered, that the applicant is entitled to re-register the vehicle in another Member State.
Problems/bottlenecks (2) • MS send requests for confirmation unstructured • paper • e-mail (sometimes with attachment) • centralized or de-centralized • no standardized electronic way for request for confirmation • no automatic processing possible • which data must be part of the request? • some MS do not react on requests (e.g. F, GR, PL) • what has to be checked before giving confirmation? • what’s in the case Part I is missing? • need for standardization and harmonization!
Check before re-registration (Art. 9) Member States shall assist one another in the implementation of this Directive. They may exchange information at bilateral or multilateral level in particular so as to check, before any registration of a vehicle, the latter‘s legal status, where necessary in the Member State in which it was previously registered. Such checking may in particular involve the use of an electronic network.
Problems/bottlenecks (3) • Functionality of checking a vehicle before its re-registration, especially its legal status (e. g. stolen, scrapped) is implemented in EUCARIS (vehicle request and response message) • Not all MS are using EUCARIS (yet) • Some MS send requests manually and unstructured (paper, fax, e-mail) • No automatic processing possible • Make the use of EUCARIS mandatory!
Activities (1) • First Meeting of Topic Group II on 26/02/2010 in Hamburg (DE) • 11 EReg Member States were present • Current state of affairs on re-registration • Common understanding of the problem • Overview on the situation in the MS • Discussion of the problems and possible solutions • Outcome/results • Directive 1999/37/EC needs adjustment/concretization especially concerning the information exchange • Need for extension of EUCARIS for exchanging notifications of re-registration • Not only focussing on the information exchange aspects but also on the re-registration procedures in the MS • Commission should be involved in the Topic Group

Activities (3) • Presentation on the work of Topic Group II at the EReg Annual Conference 12/13 May 2011 in Warsaw/Poland • Participation and presentation (by EReg chairman) on the EC Public Consultation Conference on the future initiative on re-registration of vehicles (21 June 2011 in Brussels) • Proposals from EReg for the draft regulation on re-registration based on the work of Topic Group II and IV • Planning and preparing a 3rd meeting of Topic Group II • after publication of the draft regulation • 6 June 2012 in Berlin/Germany
Mandatory use of EUCARIS to support the process of re-registration (check before and notification after re-registration) Mandatory (on-line and real time) consultation of original MS before re-registration in new MS Mandatory export (and other) signal(s) in the registration of the original MS before the vehicle may be registered in a new MS On-line availability of technical and inspection data concerning individual approved vehicles which are imported to a new MS and are offered for re-registration Data exchange through the architecture of one national contact point (being the national registration authority in each MS) Abolish the obligatory availability of Part I of the vehicle document at the re-registration of the vehicle Harmonisation of temporary documents and plates and of commercial plates (TG IV) … EReg input/proposals for draft regulation
Regulation on re-registration • Proposal for a “Regulation on simplifying the transfer of motor vehicles registered in another Member State within the Single Market” • Published on 4 April 2012 (COM(2012) 164 final, 2012/0082 (COD)) • Some preliminary remarks: • not very clear in all points • not inline in all aspects with Directive 1999/37/EC and Commission interpretative communication on procedures for the registration of motor vehicles originating in another Member State” (2007/C 68/04) • not only covering re-registration • data exchange is mandatory (Art. 4 and 7), but not the use of EUCARIS ! • national contact point concept is not mentioned • no standardization of notifications of re-registration
Results (so far) • Common understanding of the problems • Drafting an overview document on re-registration • inventory on current state of affairs in the MS concerning information exchange on re-registration • Topic Group will prepare a reaction to the draft regulation for the MS • Extension of EUCARIS for exchanging notifications on re-registered vehicles is finished • Part of EUCARIS release 6.0 • Functionalities based on requirements worked out by Topic Group • Pilot planed between RDW and KBA to use this functionality

Next steps • Meeting of TG II (combined with TG IV): 6 June 2012 in Berlin • main agenda point: draft regulation on re-registration • EC (DG Enterprise) will participate • Statement on the draft regulation (send to EC and all EReg members) • Determine next steps for the Topic Group • Finalizing the overview document on re-registration and sending this document to the EReg members and also to the EC with additional remarks on MS that do not send notifications • Starting a pilot between RDW and KBA for exchanging notifications via EUCARIS (release 6.0) • Drafting the final report of Topic Group II • Presenting the final report at the EReg Annual Conference 2013
