  1. Residency All applicants must provide verification that they are residents of California and intend to remain in California for an indefinite period before aid can be approved. They must also be physically present in California at the time of application. Verification of residence: Every MFBU must provide at least one of the following items: • Valid California Driver’s License • Current rent, mortgage or utility receipt dated in the app. month or prior month • California vehicle registration with the applicant’s address • Employment documents • Evidence of children’s school enrollment • Evidence of public assistance being received in California Clients who are unable to provide one of these documents must complete an Affidavit Under Penalty of Perjury” (LAK 540) and provide some document with a California address such as: • Telephone book listing • Property ownership document • Church record • Insurance document • Recent police records from a California law enforcement agency • Any other form of verification that appears authentic and shows the applicant as residing at a California address A person’s intent to remain in California is very subjective. The EW should review documents provided to determine if there is any evidence to the contrary. For example, if the client entered the state for the sole purpose of receiving medical treatment or having a baby means they may not intend to remain here. Another indication of plans to leave the state is possession of a ticket to return to a former state of residence. The EW must exercise good judgment in this area and, if in doubt, consult with a supervisor or manager. Failure to provide verification within the certification time limits is reason enough for denial of Medi-Cal benefits with timely and adequate notice.

ResidencySpecial Situations Homeless applicants • Must provide verification of residency using one of the documents previously described • MEDS can be used to verify previous homeless aid Migrant worker applicants • Must prove California residency during employment Non-Immigrants with visas • Those with B-1, b-2, C, D visas must provide evidence of intent to remain • Those with E, H, J, K, L and M visas are considered to establish residency for the period of the visa Minor consent applicants • Are exempt from all residency requirements; indication of intent to remain on the Statement of Facts is sufficient Children under county responsibility • If the child is in the care and control of a California state agency he or she is a resident Institutionalized applicants • Persons in California institutions are residents unless placed there by another state LTC patients placed by out-of-state family members • Must have creditable evidence to support claim of California residency • Must provide one of the required residency verifications Applicants with their principal residence out-of-state Can still be a California resident if facts are presented to support a claim of California residency. Questions to be considered: • Does the arrangement appear to be temporary? • did the person come to California for the purpose of obtaining medical care? • Is the arrangement contradictory to an intent to remain in California indefinitely? • Does the applicant have plans to leave California? EWs are to examine all “credible evidence” when determining residence. The reasons for the determination of residency or non-residency must be clearly documented in the case narrative.
