Regulation • 49 CFR Subpart F § 26.103(b): • Compliance Reviews. The concerned operating administration may review the recipient’s compliance with this part at any time, including reviews of paperwork and on-site reviews, as appropriate.
Process The review process consists of the following stages: • Notification to recipient of selection for compliance review • Request for documents • Publish review agenda • Desk review of preliminary documents • Prepare final agenda if necessary • Site visit • Final report • Compliance plan
Preliminary Notification • Initial notification by FAA to the airport that it has been selected for a compliance review • This letter would put the airport on notice of the planned review and specify an approximate date for the review.
Documentation Request • Provides a list of material needed during the review • Questions that need to be answered prior to site visit • Airports are to respond prior to the site visit
Desk Review • Prior to the site visit • Review examines applicable DBE and/or ACDBE programs, Annual Goal submissions, Accomplishment Reports, Complaints, etc. • Answers to questionnaire • The Airport’s website may be examined
Site Visit • Introductory meeting with recipients • Clarification of answers to questionnaire, if necessary • Examine applicable files • Interview the necessary parties • Same process for airport concessions • ACDBE firms interviewed in the terminal
Final Report • Issued approximately 6 weeks after exit conference • Reviewed within applicable FAA offices • Final copy sent to airport for comments
Compliance Plan • Compliance Plan agreed upon by FAA and recipient • Specific timeframe for completion • Compliance with recommended actions monitored by FAA
