DUI or Driving Under the Influence or drugs and/or alcohol is a serious offense. Nevada takes this law very seriously and often sets up DUI check points to reduce drunk driving.

Driving Under the Influence (DUI) • In the state of Nevada, DUI refers to the act of driving a vehicle while intoxicated, due to drugs and/or alcohol • It is not necessary to be visibly drunk or impaired to be subject to arrest on DUI charges
DUI Conviction • A conviction can be obtained if the individual was caught driving with a breath alcohol content (BAC) or blood alcohol level (BAL) of .08 or more, and/or drugs in their system. • Even if an individual can function normally, they can still be charged with a DUI with this level of .08 or more.
Implied Consent Law • The implied consent law is Nevada DUI legislation that any Nevada driver who obtains a state driver’s license grants implied consent for a blood or breath test if they are suspected of driving under the influence of drugs and/or alcohol.
Consequences of DUI • DMV will be notified and take appropriate action in regards to your driving privileges which could result in license suspension • Jail sentence could range from two days to six months and fines ranging from $400 to $1,000 for DUI 1st Offense.
Possible Consequences • Compulsory participation in a “Victim Impact Panel” • Eight hours of DUI School (may be done online)
DUI Checkpoints • Cops are not allowed to pull over drivers without probable cause except during a Nevada DUI Sobriety Checkpoint, where they are allowed to speak with drivers going through the checkpoint. • Police routinely set up drunk driving checkpoints to stop drivers and arrest anybody driving under the influence
DUI Checkpoints • DUI checkpoints are only legal if they are administered properly • If you are driving and see warning signs of a checkpoint, you are allowed to take any legal detour prior to that checkpoint to avoid going through it
