The broader enforcement policy Makingenforcementstrategies more cost-effective and harmonised in road transport isone of the prioritiesof the 2011 Transport White Paper. It is of crucial importance for a more integrated road transport market; A lot of progress has been done and continue to bedone in the area of the enforcement of social rules and tachograph legislation; Since 2009, progressisalsobeingdone on the enforcement of the legislation on access to profession and of other EU rules.
Outstanding ERRU-related issues to be addressed in the short term • Envisaged follow-up for questions of interpretations : • Most serious infringements of Annex IV and distribution of responsibilities between drivers and transport undertakings. The Commission will discuss with MS whether a common guidance note on the issue can help. • Administrative procedures leading to the loss of good repute. While leaving a margin of appreciation to MS, the legislator has provided for a monitoring and benchmarketing mechanism. • Two meetings with MS: ERRU WG of 15 November and Infringement WG on 10 December. ECR/TISPOL/IRU invited as observers. • MS have to fulfill their legal obligations as from 31 December 2012
Next steps • The European Parliament and the Council have asked the Commission to draw a report on the state of the EU road transport market by 2013 the internal market, including an assessment of the enforcement systems of Member States. • Possible initiative to take stock of progress made and identify possible steps to further reduce discrepancies between enforcement systems, e.g. in the area of sanctions. • It includes the definition of the serious infringements for all the areas regulated at EU levels (in addition to the most serious infringements defined in Annex IV of Regulation 1071/2009).
