  5. Nutrient Application within NSAs • Must have NMP to apply poultry litter. • Application must be made by Certified Applicator. • Resident of 2 ½ acres or less may apply at the Protective Rate or according to NMP and is not required to be a Certified Applicator.

  6. Protective Rate • Must have soil test to apply commercial P fertilizer at PR. • If no soil test is available, land owner may use recommendation of qualified person until January 1, 2009.

  7. No Protective Rate for Poultry Litter As of January 2007, Poultry litter within NSAs must be applied in compliance with a NMP.

  8. Obtaining a Plan • May request plan from conservation district or contact other certified person. • Conservation district must approve plan. • May also use comprehensive nutrient management plan drafted by NRCS, which contains a NMP.

  10. Records • Keep records for at least 5 years. • Records available for inspection by ANRC or Conservation District but not public record.

  11. Sale or Transfer of Litter • Operation is not responsible for use of litter once litter is removed from premises. • Persons receiving litter must use litter in manner approved by ANRC and must keep records.

  12. Inspections • 72 hours notice • 16 Inspectors • A minimum of 5% spot inspections per year

Litter Removal Program To remove excess litter from Arkansas NSA • Provide cost share up to $15/ton • Litter must be purchased from a registered PFO operation inside the NSA and transported outside the area • All transport will be suspended upon notice of a disease outbreak • Applicant must present an application for payment; conformation of mileage, litter weight, where applied, names and latt. and long.

  14. Enforcement • Warning Letter • 2nd offense $50 fine • 3rd offense: $500 Fine for PFO Reg. $1,000 fine For Applicator $2,500 fine for Planner and possible Suspension, revocation, annulment or withdrawal of certification

  15. Violations to Date • 13 PFO violations for late registration or failure to register • 1 complaint regarding improper setback distance • 3 violations regarding improper application by the same applicator We have received several complaints, but our rules stipulate all complaints must be signed by a notary public.

  16. How does this program affect CAFOs? • Owner or operator of a CAFO facility within a NSA must follow any ANRC requirement in addition to CAFO permit. • Must still register operation with ANRC/ Conservation District.

  17. The Illinois River CREP is….. Voluntary. If, for any reason, you feel that this program is not what you want, you don’t have to participate. We are presenting a proposal that landowners can take or leave. We are trying to provide enough incentives that landowners want to participate.

  26. Illinois River CREP - Federal Incentives SOIL RENTAL RATE THAT INCLUDES A 100% INCENTIVE PAYMENT BASED ON CURRENT COUNTY RENTAL RATES, PER ACRE PER YEAR

  27. Illinois River Federal Cost-Share and Rental Payments for CP22 & CP 29 • 50% COST-SHARE • A Signing Incentive Payment of $100/ac., one- time payment • 100% Additional Rental Payments for 15 years • ~ $9/ac. Maintenance Fee

  28. Illinois River CREP Non-Federal Incentives • State Incentive Payment - $200 per Acre Enrolled, One- Time Payment • Apply for Arkansas Riparian Zone and Wetlands Tax Credit (a dollar-for-dollar tax credit). The tax credit is calculated on 50% cost-share.

  29. Eligible Crop and Pasture Land for the Illinois River CREP • All CRP Practices in this CREP require cropping or grazing history - 4 out of 6 years between 2001 and 2006
