  3. Private Forest LandChaos, Connivance & Corruption.. • Govt., BMC projects,funds,activities banned • Sale, Resale shifting transfer of property not allowed • Prohibition of Registration of Properties in this areas

Chronology of Events • 2002-05 – State Govt. filed Affidavit to enroll Private Forest in 7/12 • 2004 & 2005 – State Govt. issued instruction not to allow development on Private Forest Land • 30/5/05 - Mumbai High Court Final Order on PIL on Private Forest Land • 30.5.2006 - Govt. should complete, correcting land records

  7. Chronology of Events… • 1/6/2005 to 31/12/2005 - Forest Conservator submitted list of private forest land to Collector • June 2005 to May 2006 – Collectorate recorded private forest on 7/12 • Mar-Apr 2006 – Kirit Somaiya filed PIL • Mar-May 2006 – BMC issued stop work notices

Chronology of Events… • Apr-Aug 2006 – Mulund Residents Association & Others filed PIL • Interim Relief by High Court • State Govt. objected the Interim Relief • 2006-07 – State Govt. filed Appeal against the Relief in Supreme Court. • 2007 – Supreme Court Interim Order for Statuesque and not to create hurdles

Affidavit in Mumbai High Court • State Govt. argued all Survey No. / Plots against which notices issued in 1954-57 are forest and development is illegal / stopped / disallowed • Appeal been filed by Mulund Residents Association & Others in the Supreme Court • 22.8.08 - Supreme Court next hearing

  10. State Govt. Attitude / Action • Declared 67000 Tenants / houses – Forest • Changed 7/12 – Law Revenue Record unilateraly • State Govt., Chief Secretary, Forest Dept. filed affidavit “All this structures / tenements are illegal / encroachment • Protection of Forest –environment is must

  11. State Govt. Attitude / Action… • All piece of land / survey no. against which notices were issued during 1954-57 are Forest • Opposed the Residents Association, Refugee Colonies etc. • Declared the Govt. Building, ESIS Hospital etc. Forest & Illegal

  12. Chaos or Corruption ? • Minister’s announcement 67000 household be protected • Chief Minister, Forest Minister made public statement “Govt. action is absorbed • State Govt. took opposite position in High Court that – “No consideration for Innocent Residents”

  13. Chaos or Corruption ?... • State Govt. ordered BMC to declare this zones forest • Asked BMC to issue stop work notices • State Govt. / BMC stopped welfare, Road Repair works in this zone. • No protective measures for 5 lac Residents initiated by State Govt. in last 3 yrs.

  14. Chaos or Corruption ?... • New Big Project “Private Forest Notices withdrawn” • Convenient interpretation of Rules, Guidelines, Law, Order • Sufferer are 4-5 lac innocent citizen • BJP demands protection of 67000 families – 4-5 lac innocent residents first.

Big Project Clearance • Land against which Notices were issued in 1954-58 • Private Forest Entries entered in 2005/06 • Stopped Work Notices were given • Compromise / Settlement by SGNP but not cleared by Private Forest – Dept / Conservator • Cleared Now/Ignored/Special Treatment by *Sanjay Gandhi Notional Park (SGNP) *Private Forest (Thane Conservator) *Revenue & Forest Ministry *Collectors *BMC • Accommodative interpretation of Provisions, Court Interim Relief

Big Project Clearance… • Cleared / NOC / Permission given to Private Builder, though Notices issued… in 1954-57 • Private Forest during 1954-57 but released now with FLIMSY Petty Penalties • Permission now given for development in the name / provision of Private Forest Land – Non Applicability. (Sec. 6, Sec.3(2) or so)

  17. Big Project Clearance… • Construction, Development, O.C. are given • Permissions, O.C. etc. allowed in the name of “Interim Relief” given by court. • O.C. issued in the name of “Property” being given / handed over to BMC/Govt. (Accommodation Plots etc.) TDR issued against the same.

  18. BJP Demands • Protect 67,438 Common Men Houses • FIRST Innocent Residents • Special Provisions-Amendment in this Assembly Session • Facilitation of BIG at the cost of Small be stopped • Protect 5 lac Residents KIRIT SOMAIYA GOPAL SHETTY
