Office of Professional Conduct Overview • On behalf of the State Board of Education, administers the ethical standards for educators. • Investigates allegations involving criminal convictions or conduct unbecoming to the teaching profession. • If warranted pursues disciplinary or remedial action against a teacher’s credentials or application for credentials. 2

  3. ODE/PSCA Collaboration • Currently, PCSA report: • initiated investigations of abuse or neglect involving an educator • the disposition 3

  4. Amended House Bill 79 • Signed by Governor Taft on December 29, 2006 • Effective March 29, 2007 • Creates a cohesive system to address educator ethics and sharing of information between ODE and PCSAs 4

  5. HB 79 Requirements Upon request by ODE, PSCA are now allowed to share information regarding: • the alleged victim • the alleged perpetrator • interviews conducted • prior history of alleged perpetrator 5

  6. HB 79 Requirements Criminal prosecutions take precedent • Consult with prosecutor regarding status of criminal proceedings • If charges are being pursued, the prosecutor will determine what information can be released to ODE 6

  7. HB 79 Requirements Confidentiality Critical to successful sharing of information RC§3319.31/OAC Rule 3301-73-04 - ODE investigations confidential Additional safeguard RC§2151.99– unauthorized dissemination by ODE is a 4th degree misdemeanor 7

  8. PCSA Reporting Form • To assist in sharing information between PCSAs and ODE • Based on requirements of HB 79 • Created collaboratively with ODE, county PCSAs and ODJFS 8

  9. Reasons for Sharing Information • Complementary approaches • Differing burdens of proof • PSCAs expertise in assessment and identification of child abuse and neglect reinforce ODE’s decision to initiate an investigation • Aids ODE in identifying information sources 9
