Chapter 19, 15th of March 2011 Health and Safety at Work
The Framework Directive 89/391/EEC The following laws and regulations implement the Framework Directive: On land Act on Working Environment, Health and Safety in Workplaces No. 46/1980, with subsequent amendments. The Regulation on the Organisation and Implementation of Health and Safety at Workplaces, No. 920/2006. The Regulation on the Protection of Workers from the Risk related to Chemical Agents at Work, No. 553/2004.
The Framework Directive 89/391/EEC The following laws and regulations implement the Framework Directive: At sea The Regulation on Measures to Improve Occupational Safety and Health of Seamen on Board Vessels, No. 200/2007. In the air The Regulation on Measures to Advance Implovements in Safety and Health of Crew Members, No. 680/1999
Preventive Approach • Written Programme of Safety and Health at Workplaces which shall includes: • A Risk Aassessment and Special Risk Assessment as a appropriate • Health Protection Schedule • Schedule of preventive measures • Workers’ representatives shall be consulted. - it depends on the size of the companies how the consultation will be done, see chapter II of the Act. • Suitably qualified service providers.
The Employer’s Obligations • The employer has the overall responsibilities for the health and safety at the workplace; • The employer shall inform the employees of all dangers of accidents and health hazards which may be associated with their work. • The employer shal ensure that the employees receive education and training for their jobs to minimize dangers associated therewith.
The Employer’s Obligations (cont.) • The employer shall pay expenses incurred through actions aimed at the improvement of the working environment, health and safety and reimburse those who suffer loss of income due to this activities. • The employer shall guarantee that those elected to deal with working conditions, health and safety in the workplace and those who are members of the safety committee are allocated appropriate time to attend to their duties as supervisors of the working environment, health and safety.
