Section 504 of the Rehab Actof 1973 • No otherwise qualified individual with a disability shall, solely by reason of his/her disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity of a public entity. P.L. 933-112 Section 504

  3. “Otherwise Qualified” • The Supreme Court – “an otherwise qualified person with a disability under Section 504 is one who is able to meet all of the program’s requirements in spite of that person’s disability”

  4. Otherwise Qualified • Students must meet criteria for admission. • Students must evidence the potential to do the work. • Students must be able to meet academic standards of institution

  5. Americans with Disabilities Act1990 • Title II • Prohibits discrimination on the basis of a disability • It is a civil right. • Only minority group not protected under the Civil Rights Act of the 60’s • Only group of which one can become a member of at any time

  6. CRITERIA FOR ACCOMMODATIONS • REASONABLE • EFFECTIVE • MUST NOT ALTER THE CURRICULUM OR COURSE REQUIREMENTS • MUST NOT PRESENT AN UNDUE ADMINISTRATIVE BURDEN

  7. Procedure for Receiving Services STUDENT’S RESPONSIBILITY: • Contact Office of Disability Services • Provide documentation of disability • Request the services • each semester • Instructor letter provided for student • Student Delivers letter to professor

  8. Testing Procedures • Student may (or may not) remind you regarding his/her testing accommodations • Student schedules exam with ODS for same time that the class meets • If the time/date is to be different ,you must approve it. ODS does not make those changes • ODS contacts you by email and arranges for the delivery of the exam.

Cheating is not a disability issue • Profile of college students more likely to cheat: Business or Engineering majors; Those whose future plans include business; Men self-report cheating more than woman; Fraternity and Sorority members; Younger students; Students with lower GPA's or those at the very top. • Information from the ETS and AD Council • Campaign to address academic misconduct http://www.glass-castle.com/clients/www-nocheating-org/adcouncil/research/cheatingfactsheet.html One study indicated 75%-98% college student’s admitted to cheating in some form.

  10. 52.8 percent indicated they had never committed any deeds of academic misconduct. The higher one's classification the more likely one would engage in acts of academic dishonesty.   13. What is not a disability? • Irritability • Irresponsibility Just like any other student, students with disabilities come in all sizes, personality types and their own set of strengths and weaknesses. People First is more than a politically correct statement.
