  3. LUMPUR OH LUMPUR • SYNOPSIS: This case is focusing on the inefficient mitigation measures (ESCP for EIA) of the Fasa Cahaya construction site. It all started with the mud flood problem faced by a few villagers in Kampung Janda, Negeri Sembilan, after 2 hours of extreme localised rainfall. This flood has caused many losses to the villagers and they were asking for compensation from the developer of Bandar EMAS Project. The failure in the negotiation between the villagers and the developer has pressured the villagers to report the scenario to a sensational TV program ‘Dedahan Sensasi’. After the reveal of the mud flood issue in Kampung Janda, the developer faced challenges in solving the compensation issues and complying to the EIA approval terms. On the other hand JPASNS faced challenges in helping the developer and EIA consultant to solve their problems and to clear all the negative perception on JPASNS’s enforcement as being reported by ‘Dedahan Sensasi’.

  4. CASE FLOW • Scenario 1: The Mud Flood in KampungJanda • 26 April 2010, 5.00 pm. • A group of affected villagers discussing on their problems caused by the mud flood. They were very angry and blaming the Bandar EMAS Project as the culprit causing the problem. They decided to ask some compensations from the developer based on their losses. • 26 April 2010, right after the rain stopped. • A construction worker of FasaCahaya reported to the management office of the Bandar EMAS Project about the mudflow problem. The Project Manager of the Bandar EMAS Project rushed to the FasaCahaya to check on the extend of the damages occurred due to the heavy raifall.

CASE FLOW • Scenario 3: Commotion at the Site Office of Bandar EMAS • 27 April 2010, 8.00am. • The village leader went to the site office of Bandar EMAS asking for compensations for all the villagers’ losses total of RM16,500. The negotiation failed and the village leader threatened to report the issue to ‘DedahanSensasi’. • Scenario 4: ‘DedahanSensasi’ • 27 April 2010, 9.00pm. • Sukaimi (JPASNS Enforcement Officer) was watching the television when the ‘DedahanSensasi’ revealed on the mud flood incident in KampungJanda. He contacted the Project Manager for an appointment on the next day to check on the condition of construction site.

CASE FLOW • Scenario 5: The Site Visit to FasaCahaya, Bandar EMAS Project • 28 April 2010, 8.00am. • Sukaimi and a few JPASNS enforcement officers went to FasaCahaya, Bandar EMAS to inspect on the condition of the construction site and to check on the mitigation measures especially the Erosion and Sediment Control Plan (ESCP). Sukaimi suggested for the Project Manager and the EIA Consultant to have a meeting with him as soon as possible to discuss on the issues and to come up with the solutions. He also needed the information for a report that he has to produce as requested by the Director of JPASNS.

  7. CASE FLOW • Scenario 6: Sukaimi’s Dilemma • It is so important for Sukaimi to help the developer and the EIA consultant in resolving the issues that they’re facing. He himself were having a hard time and being pressured by JPASNS’s Director to produce a report on the whole incident and the actions taken to resolve the issues and problems.

TEACHING GUIDE • Learning Objectives: • To identify the issues and problems of the EIA’s implementation in the project management of Bandar EMAS. • To analyse the issues and problems of the EIA’s implementation in the project management of Bandar EMAS. • To resolve the issues and problems of the EIA’s implementation in order to abide to the EIA’s approving terms in the project management of Bandar EMAS. • Target Groups: • The Management and Professional Group with at least 3 years of working experience in the development planning, land-use planning, management and conservation of environment and natural resources and other relevant sectors. • Local Council • NGOs
