Vocabulary: • Search Warrant – a court order allowing law enforcement officers to search a suspects property for evidence • Indictment – a formal charge in court by a grand jury • Grand Jury – a group of citizens who review the evidence against someone to determine if they will be charged with a crime

  3. Vocabulary: • Double Jeopardy – a person is charged with the same crime more than once • Due Process – established legal procedures • Eminent Domain – the right of the government to take private property for public use • Bail – an amount of money that someone who is arrested pays to the government as a deposit to make sure they return for their trial

  4. Vocabulary: • Militia – a small local army made up of volunteer citizen soldiers • Civil Case – a lawsuit that involves disagreements between people rather than a crime • Criminal Case – a court case that involves someone breaking the law

  5. 1. Which amendments protect the rights of a person who has been accused of a crime? • Fourth Amendment • Fifth Amendment • Sixth Amendment • Eighth Amendment

  6. 2. What does the 4th amendment protect Americans from? • Unreasonable Searches and Seizures • Police cannot search your home or take your property without probable cause • Police need a search warrant to search your property

What is the difference between being indicted on a crime and being found guilty of a crime? • An Indictment means that the jury has found enough evidence to think that the person may be guilty of a crime and should be charged. • After an indictment the person will have to go through a trial to determine if they are guilty or not

  8. 4. What does the 5th amendment say about double jeopardy? • A person who is found not guilty of a crime cannot be charged with the same crime again. • Even if more evidence is found that proves the person is guilty.

  9. 5. As far as confessions, what does the 5th amendment state? • People have the right to remain silent so they do not make themselves look more guilty

  10. 6. What effect does the 5th amendment have on eminent domain? • The Government must pay a fair price for any property they take under eminent domain.

  11. 7. What does the 6th amendment entitle people accused of crimes to? • Be made aware of the charges being placed against them • A trial by Jury • The right to a lawyer

  12. 8. According to the 6th amendment what happens when someone cannot afford a lawyer? • The government must provide one and pay the fees

  13. 9. What does the 8th amendment protect Americans from when it comes to bail? • Judges cannot ask for excessive bail • Bail that is too high

  14. 10. What does the 8th amendment protect those Americans who are found guilty of a crime from? • Protects Americans from cruel and unusual punishment

  15. 11. Why was the 2nd amendment written? What do many people believe it means today? • For each state to be able to set up a militia to defend itself • Most people today think that it is the right for any Americans to own firearms

  16. 12. What does the 3rd amendment state? • During peacetime soldiers cannot be housed in private residences.

  17. 13. What type of court case does the 7th amendment refer to? • During a Civil Case it the means that if the amount of money being argued over is more that $20 then the people have a right to a trial by jury

Defendant: 11-year-old little league baseball player Claim: Wrongful warm-up Details: A New Jersey little leaguer was tossing around before a game in 2010 when the ball got away from him and found Elizabeth Lloyd’s face. The child asked her if she was all right, she responded affirmatively, then filed a lawsuit against him and his family for a half million dollars in medical costs, pain and suffering a few weeks later. Result: Little league insurance policies don’t cover spectators, so the kid’s on his own. The case is still pending.

Result: A judge dismissed the woman from the complaint, and cited GPS devices, large billboards and push notifications from news websites as similar distractions that drivers have the responsibility to avoid

  21. 15. What does the 10th amendment allow? • Allows the states and people to keep all of the powers not specifically given to the federal government in the Constitution • Reserved Rights
