  2. Legal Requirements • S12 of ASB Act 2003 came into force on 30th June 2004 • Duty on RSLs and Local Authorities to produce and publish a policy and procedure on tackling ASB by 30th December 2004 • ASB is broadly defined • RSLs should have regard to guidance issued by the Housing Corporation

  3. Housing Corporation guidance • All RSLs have a statutory duty • HC therefore discussed its approach with organisations representing specialist associations, including co-ops • Don’t have to be registered to be affected – guidance also refers to the role of managing agents • Model policies – CCH has developed an excellent template – available from the CCH website • Resident consultation

  4. What will these policies achieve? • Complainants need to know what options are available to them if they experience ASB • Also need to know what sort of remedies their landlord will use and consider (e.g. Acceptable Behaviour Contracts, Anti-Social Behaviour Orders)

  5. Key issues in tackling anti-social behaviour • Balanced approach – prevention, enforcement and rehabilitation • Testway HA, Whitefriars, Irwell Valley • Incremental approach • ASBOs – the tip of the iceberg? • Circular 07/04 – eviction as the last resort

  6. Some good practice examples • Not rocket science – Salvation Army HA (also not about working on your own) • Belgrave Neighbourhood CHA • BME co-op in Leicester – 332 units • AC inspection – good service • Proactive management of reported cases • Good recording and links to CDRP • High levels of tenant satisfaction • Encourage people to report racially motivated incidents • Support complainants and their families and • Take action against perpetrators

  7. Translating policies from other organisations to co-ops • Funding is an issue • DIY alternatives • Working with and learning from others • Access to partnerships can be difficult for smaller organisations
