Legal Requirements • S12 of ASB Act 2003 came into force on 30th June 2004 • Duty on RSLs and Local Authorities to produce and publish a policy and procedure on tackling ASB by 30th December 2004 • ASB is broadly defined • RSLs should have regard to guidance issued by the Housing Corporation
Housing Corporation guidance • All RSLs have a statutory duty • HC therefore discussed its approach with organisations representing specialist associations, including co-ops • Don’t have to be registered to be affected – guidance also refers to the role of managing agents • Model policies – CCH has developed an excellent template – available from the CCH website • Resident consultation
What will these policies achieve? • Complainants need to know what options are available to them if they experience ASB • Also need to know what sort of remedies their landlord will use and consider (e.g. Acceptable Behaviour Contracts, Anti-Social Behaviour Orders)

Translating policies from other organisations to co-ops • Funding is an issue • DIY alternatives • Working with and learning from others • Access to partnerships can be difficult for smaller organisations
